Special Terms and Conditions of Carriage of TUIfly Vermarktungs GmbH (hereinafter referred to as TUIfly.com) in the capacity of Contracting Carrier for Carriage executed by Corendon Airlines as Actual Carrier

1. Scope

1.1
These Special Terms and Conditions of Carriage ("STCC Corendon Airlines") apply to all flights and other services for which a contract has been concluded with TUIfly Vermarktungs GmbH (hereinafter referred to as "TUIfly.com") with reference to the General Terms and Conditions of Carriage of TUIfly.com (hereinafter referred to as "GTCC") and which are executed by Corendon Airlines (hereinafter referred to as “Corendon Airlines”).

1.2
TUIfly.com is the contracting air carrier defined in legislation governing carriage by air and is party to the contract with the passenger. If TUIfly.com allows Corendon Airlines to handle the carriage to which the passenger is entitled, Corendon Airlines is the actual carrier as defined in legislation governing carriage by air.

1.3
In addition to these STCC Corendon Airlines, the GTCC of TUIfly.com also apply. In case of conflict between the STCC of Corendon Airlines and the GTCC, the GTCC shall take precedence.

2.1
Corendon Airlines customer service shall process all bookings to be made directly with Corendon Airlines. Corendon Airlines customer service can be reached by fax at +90 242 324 32 40 or by e-mail at customer@corendon-airlines.com.

3. Prior to Departure

- Please have your travel agency confirm your flight one day before departure and check to see if there have been any changes.

- Please be at the check-in desk two hours before departure. Make sure that the correct baggage label is on your baggage for the flight.

- The check-in desks close 45 minutes before the scheduled flight. Passengers that arrive after the check-in desk has closed will be refused carriage, their reservation will be cancelled and they will not receive a refund.

- At check-in, our passengers must present valid personal identification with a photograph (also applies for children and infants). With regard to visa formalities, please contact your travel agency or the respective consulate or your embassy. Passengers must carry all required travel documents with them and comply with the laws, regulations, instructions and travel conditions of the respective country at all times (departure, arrival, transit). Corendon Airlines is not responsible if passengers are not accepted onto the flight due to problems with identification, passport, visa or tickets.

- Please note that Corendon Airlines is entitled to photocopy or make digital copies of passports, visa documentation or other personal documents.

- At check-in you will receive the boarding pass which lists the gate number, departure time and your seat number. Passengers without boarding passes are not permitted to board the aircraft.

- In addition to the price of the ticket, Corendon Airlines can also require the payment of a fuel surcharge to offset the fluctuation in fuel prices on the global market.

- Please note that Corendon Airlines reserves the right to have the flight carried out by another air carrier even if you have purchased a ticket for a flight with Corendon Airlines.

- All Corendon Airlines flights are non-smoking flights.

- For a fee of EUR 15, our passengers can reserve a seat with more leg room in the first row or in the emergency exit rows on flights from Western European countries (Holland, Belgium, Denmark, France, Germany, Italy, Poland, Estonia, Norway, Sweden, Finland), Eastern European countries and Middle Eastern countries (Iran, Israel, Kosovo, Romania). The fee includes a non-alcoholic beverage.

4. General Safety Measures

- We recommend limiting your baggage to personal items that you will need on board the flight.

- If possible, keep any liquids with your checked baggage.

- Before your arrival at the airport, place your liquids in a resealable plastic bag.

- Clarify all of your questions with the airport or your airline before you leave for the airport.

- Have the resealable plastic bag containing your liquids available for the security check. It will be x-rayed together with your carry-on baggage.

- You must remove your coat and/or jacket. Place all metal items, including wallets, in a plastic container to be x-rayed separately.

- If you are carrying a notebook or another large electronic device in your carry-on baggage, please prepare to have this x-rayed separately at the security checkpoint.

- Duty-free goods or goods purchased in the departure area: You are permitted to bring liquids in containers of any size purchased in the departure area following the security check along with you on the flight.

- Most of the duty-free goods or similar products will be given to you in a specially sealed bag. You are not permitted to open this bag until you arrive at your final destination. In addition, during your trip you must keep all of your purchase receipts, which you must present whenever you change planes.

- If your flight departs from an airport outside of Europe and you change planes at an EU airport, you are not permitted to bring the duty-free goods that you purchased at the airport outside of Europe with you onto the plane.

Liquids:

Passengers are permitted to bring small amounts of liquids with them, but they must be carried in containers with a volume of no more than 100 ml.

These containers must be carried in a resealable, transparent plastic bag (approx. 20 cm x 20 cm) with a maximum volume of 1 litre. The containers must fit easily into the plastic bag and the bag must be sealed. Each passenger is permitted to bring one bag of liquids along. The bag must be presented at the security checkpoint at the airport. Liquids that do not fit into the resealable bag must be checked with the check-in baggage. An unlimited amount of liquids is permitted in the checked baggage.

Do not forget that the definition of "liquids" includes the following items:

  • All beverages, including water, syrup and soups
  • Creams, lotions, oils, perfume, mascara, etc.
  • Sprays and pressurized containers, including shaving cream and spray deodorant
  • Any type of paste, including toothpaste
  • Gels, including hair gel and shower gel
  • Other solutions and substances with similar consistency
Medications:

 

Required medications and baby food in amounts that exceed 100 ml can be brought along on the flight. Permission to bring these items must be confirmed, however.

Every passenger has the right to go through the security check with an item (in addition to the resealable plastic bag). Wheelchairs, walker and strollers are allowed.

Laptops/Electric Devices:
Laptops and other large electric devices (e.g. large hair dryers) must be removed from the carry-on baggage and x-rayed separately. Laptops are permitted in the cabin.

Extra Large Items:
Baggage that does not conform to the carry-on baggage dimensions must be checked. As an exception, musical instruments are accepted as a second piece of baggage, but they must also be x-rayed at the security checkpoint. Passengers must clarify with the respective airline if such large instruments require special measures (e.g. reservation of an extra seat).

5. Baggage

In General:
a. On all Corendon Airlines flights, passengers are permitted a free piece of baggage of 20 kg in addition to their carry-on baggage. Free baggage is not permitted for children who are not yet two years old.

b. Umbrellas, canes, packages and similar items are not permitted to be checked as cargo baggage because they can cause damage.

c. Fragile items that must be carried in cargo must be packed accordingly; otherwise, carriage will be refused. Corendon Airlines does not accept any liability for this type of item.

d. In addition to the afore-mentioned free baggage, each passenger is permitted to bring the "personal items" listed in the section below at no cost.

e. Assistance dogs for passengers with visual impairments are considered person items. The weight of pets brought along onto the flight, together with their crates, is considered excess baggage, even if the baggage of the respective passenger does not exceed the free baggage limit.

f. If the applicable free baggage amount is exceeded, a fee must be paid for the excess baggage.

g. Excess baggage is only accepted after the fee has been paid.

ii. Acceptance and Return of the Baggage

(a) Passengers are responsible for picking up their baggage as soon as it is available for pick up at the destination or the intermediate stop. If passengers do not pick up their baggage within a reasonable period, Corendon Airlines is entitled to charge the passenger a storage fee.
(b) Only the person to whom the baggage claim check was given at the time the baggage was checked is authorized to pick up the baggage.  

iii. Special Items / Substances as Baggage or in Baggage
The following items can, as an exception, be taken along by the passenger as baggage or in baggage and are considered excess baggage:

Small calibre ammunition for hunting and sporting firearms can be brought along in small amounts in checked baggage (it is NOT PERMITTED to be brought along in or as carry-on baggage).

Bicycles can be brought along as checked baggage in the cargo area of the aircraft. The pedals, however, must be turned inward and the handlebars must be affixed parallel to the frame.

Air tanks for compressed air used for diving will be transported only if they are completely empty. The passenger is required to provide evidence of this.

Oxygen apparatus is not permitted for transport. Corendon Airlines shall provide oxygen for passengers if required. Other special requests are subject to approval by Corendon Airlines.

• The transportation of strollers/buggies is allowed. However, they must be folded up and secured so that they cannot be unintentionally opened.

Radio receivers are permitted for transport, but their use during the flight is not allowed.

Wet cell batteries are transported as baggage.

Wheelchairs are transported at no cost if the respective passenger is reliant upon it. Battery-operated wheelchairs will only be transported if the battery is dry and cannot leak.

iv. Personal Items
All items that passengers are allowed to bring with them without a baggage claim check or without being weighed are considered personal items. These items are not registered on the flight ticket. The passenger alone is responsible for them. The following items are accepted as personal items. All other items are considered baggage.

  •  Women's purses or wallets
  • Books, newspapers, etc. that will be read during the flight
  • Coats, blankets or scarves
  • Umbrellas or walking sticks
  • Small cameras and/or binoculars
  • Baby carriers
  • Wheelchairs that can be folded up and/or passenger prostheses

v. Carry-on Baggage
Carry-on baggage refers to all items which are not personal items, but which passengers are permitted to have in the cabin during the flight. Carry-on baggage is limited to one piece per person and seat (children are not allowed to have carry-on baggage). The passenger alone is responsible for his or her carry-on baggage. Carry-on baggage must meet the following requirements:

- Maximum weight: 6 kg (11 lb)

- Maximum dimensions: 45 × 35 × 15 cm (18 × 14 × 6 inch)

Items that exceed the limits listed above and sensitive items, such as musical instruments, works of art, cameras, or similar items will only be transported in the cabin as an exception by special request of the passenger and only if permission was granted by the district manager. The items must be under the supervision of the passenger. If the items are too large to be transported in the cabin, they must be transported in the aircraft cargo area. The respective items must be packed appropriately so that they are not damaged.

vi. Hazardous Items
a.
The transportation of hazardous items with CORENDON AIRLINES is allowed in compliance with the "IATA Hazardous Item Regulations".
b. Hazardous items
i. must be identified as such
ii. must be checked for damage or leaks before they are stored in the cargo area
iii. must be loaded very carefully, so that people and items are not in danger
iv. must be handled in accordance with the special handling information on the packaging, i.e. arrow with "This side up", etc.
v. must be loaded and secured in the cargo area such that they do not shift during the flight
vi. must be checked for damage and leaks after the aircraft is unloaded.
c. Hazardous items are never permitted for transportation in the cabin or cockpit!!
d. Hazardous items are not permitted for transportation as baggage (checked or carry-on baggage) or as part of baggage or in baggage. The items and amounts listed in section (f) are exceptions to this rule.
e. In general, the following items are considered hazardous and are not permitted for transportation as checked or carry-on baggage.
i. Briefcases with alarm devices
ii. Compressed gases, such as camping gas and spray bottles (flammable, not flammable, poisonous) (except for the types and amounts listed in section B below)
iii. Corrosive materials (such as acid batteries, alkaline batteries, wet cell batteries), pathogenic agents
iv. Explosive substances, fireworks and signal flares
v. Flammable liquids and solids (lighter fluid or heating fluids/fuels, matches, paints and other substances that ignite easily)
vi. Irritants
vii. Magnetized substances
viii. Oxidizing substances (bleaching powder and peroxide, etc.)
ix. Poisonous substances (e.g. mercury)
x. Radioactive substances
f. The following items can be brought along as baggage or in carry-on baggage (checked baggage and carry-on baggage)
i. Medications and cosmetics that are necessary or meet a purpose during the trip such as hair spray, perfume and medications that contain alcohol. If all of the packages that the respective passenger requires do not exceed the overall total content of 2 kg or 2 litres (75 fluid ounces), they can be transported in the cabin or in the cargo area.
ii. Dry ice to protect goods from spoiling, only as carry-on baggage with a maximum amount of 2.5 kg (5 lbs) per person
iii. Up to 5 litres of alcoholic beverages
iv. Small bottles of oxygen for medical purposes and small carbon dioxide gas bottles for operating mechanical organs
v. Small calibre ammunition - except for explosive or flammable projectiles - for hunting or sport as checked baggage with maximum amount of 5 kg per person
vi. Personal smoking accessories, including lighters with fluid, excepting lighters with flammable fluid containers and refill cartridges for lighter (gas or fluid)
vii. Service items, technical items.
Passengers with firearms must check in at least 90 minutes before the planned departure time.
ix. Electronic Devices
a. The following electronic devices must be switched off during the flight:

  • Mobile phones
  • Radio phones
  • CD players
  • Remote control toys
  • Portable printers
  • CD-ROM drives (laptops)
  • Radios
  • Mini-TVs

b. Use of the following electronic devices is permitted during the flight: (only after departure, before landing)

  • Laptops (only those without CD-ROM drive)
  • Walkman
  • Gameboy
  • Video camera

6. Baggage Problems

a. General:
• First, on behalf of the ground handling company, we would like to apologize for any type of baggage problems such as damage, delay or loss that occur during a Corendon flight.

In such a case, contact the lost and found office at the airport immediately and fill out the PIR form (Property Irregularity Report) to register a damage or loss complaint. Without a filled out PIR form, claims will not be acknowledged.

• In case of damage or loss of baggage, the passenger must submit a complaint directly upon landing at the destination airport. Later claims must be submitted in writing within seven (7) days following baggage pick up (in case of baggage damage). In case of delay in receiving baggage, the complaint must be submitted within twenty-one (21) days following return of the baggage.

• If the baggage was received without complaint, it is assumed that the baggage was transferred in good condition. < /p>

• Because processing such complaints through private insurance companies is often more advantageous for passengers, please contact the insurance company first because they appraise the baggage according to its value. In most cases, Corendon Airlines pays for damage based on weight. The payment is limited to the amount equal to the price of a one-way flight ticket.

• In addition to a copy of the PIR form that you filled out at the airport to report a baggage delay or damage, please submit the baggage label, the boarding pass and copies of the corresponding documentation so that we can process your claim quickly. We recommend that passengers keep the original documentation regarding their baggage claims. All of the required documents and explanations must be submitted in German, English or Turkish.

• Corendon Airlines shall not refund the costs for procuring the required documents.

• All claims must be supported by purchase or repair receipts (e.g. cash register receipt, invoice), a copy of your flight ticket or reservation, damage report (PIR form), boarding pass and baggage identification tag.

• We recommend that passengers purchase insurance for important, sensitive or valuable items to cover the baggage and the value of the baggage contents.

• Corendon Airlines does not accept liability for fragile or perishable goods, jewellery/money, precious metals, computers, personal electronic devices, securities, bonds and other similar instruments, business documentation, medical documentation, passports, samples, other identification documentation and other items that are not permitted for transport or in case an item/baggage is delayed or damaged due to a security check.

• In addition, Corendon Airlines does not accept liability for damage or loss with regard to protruding items such as rollers, base feet, locks, hooks, handles or other items affixed to baggage. Furthermore, Corendon Airlines does not accept liability for items lost because baggage was packed poorly or is too full, nor for cuts, scratches, scuffs, dents or spots.

• Corendon Airlines does not accept liability for personal items that are misplaced or lost in the aircraft or in the airport terminal. All items that are forgotten in the aircraft are taken to the lost and found office at the destination airport.

• Corendon Airlines does not accept liability for occurrences that happen to the passengers' items in the cabin during the flight unless such instances are due to gross negligence on the part of Corendon Airlines.

Please note that complaints/claims are only accepted in German, English or Turkish.

Corendon Airlines does not accept liability in the following cases:
i. Loss of baggage checked with a group (except for families/couples that share a residence),
ii. Damage or loss of baggage and personal items that are transported under the supervision of the passenger and were not checked, unless this damage or loss occurs due to negligent behaviour on the part of Corendon Airlines,
iii. Costs for transporting baggage that was lost and later found to the passenger's address or costs incurred by the passenger for travelling to the airport to pick up the baggage because Corendon Airlines is only responsible for bringing the baggage to the airport listed on the baggage label and passengers must pick up the baggage at the airport themselves (if passengers do not wish to pick up their baggage themselves and demand that the baggage be brought to their respective address or hotel, Corendon Airlines is not liable for damage, loss or the time lost during and due to baggage transport).
iv. Attorneys' costs,
v. Fees for bank transfers in case of damage replacement payments or deductions due to incorrect bank account information.

b. Lost Baggage:
If the search for your baggage does not yield positive results, please contact the customer service department of Corendon Airlines and provide copies of the documents listed below:

  • Lost baggage claim (PIR form)
  • Flight ticket
  • Boarding pass
  • Baggage labels that indicate the weight of the baggage
  • Receipts for excess baggage fees
  • If your baggage tag is ripped, a list of the items in your baggage in German, English or Turkish (in particular, indicate brand names, such as perfume names and brands, shoe sizes, clothing with brand names, titles of books, etc.)

Corendon Airlines does not accept liability for baggage that was not registered to the name of the flight ticket or boarding pass holder and that does not have a label.

c. Damaged Baggage
Please contact the customer service department of Corendon Airlines and provide copies of the documents listed below:

  • Report regarding damaged baggage (PIR form)
  • Flight ticket and boarding pass
  • Baggage label of the damaged baggage
  • If your baggage can be repaired, the repair invoice from the repair shop
  • If your baggage cannot be repaired, an explanation from an authorized repair shop indicating that the original baggage cannot be repaired and used as well as the estimated value and age of the original baggage
  • Purchase receipt of your baggage (if the receipt is not submitted, the highest payment shall be half of the price of the baggage)

7. Damage Claims

a. Damaged Baggage:
Damage claims for checked baggage are not permitted to exceed the price for a one-way ticket and is calculated according to the following formula:

Price - age of baggage (10 % per year) (In the calculation, the age of the baggage shall be rounded to the nearest complete year.) Corendon Airlines does not accept liability for lost, soiled or damaged items in damaged baggage. Damage claims for damaged items in damaged baggage are only paid if the items were permitted to be transported and if their purchase or repair can be documented (cash register receipt, invoice, etc.). The reimbursement is not based on the replacement baggage, but instead on the damaged baggage after deducting wear and tear. If the passenger cannot provide documentation of the ticket price, the airline shall use the one-way ticket price or a maximum of EUR 100. Corendon Airlines shall not pay for any costs related to the required documentation. If no fees are paid for repairing the damaged baggage, Corendon Airlines shall not make any reimbursement to the passenger. Corendon Airlines has the right to require that the passenger provide irreparable and unusable baggage to the ground handling company and the passenger is responsible for the related costs.

b. Delayed Baggage Pick-up:
If checked baggage pick up is delayed, the following reimbursements are made to the passenger for costs that are clearly necessary:

If lost baggage is not found within 72 hours after the date it is requested, Corendon Airlines shall pay a total advance claim of EUR 50 (maximum) if the delay was not caused by a force majeure event. If the baggage has definitely been lost, the claim paid in advance shall be deducted from the final claim paid.

c. Lost Baggage:
If checked baggage is lost, the passenger shall be paid the actual value of the lost baggage, which shall not exceed EUR 10 per kg for international flights and EUR 5 for domestic flights. The free baggage limit for all flights is 20 kg. The damage claim cannot exceed the price of a one-way flight ticket. If the passenger cannot provide documentation of the ticket price, the airline shall use the one-way ticket price or a maximum of EUR 100. If the passenger cannot provide documentation of the baggage weight, a weight of 10 kg shall be used for the lost baggage. Strollers, wheelchairs and similar items are subject to the same conditions as checked baggage.

d. Exclusion of Liability:
Corendon Airlines does not accept liability for fragile or perishable goods, sporting equipment, instruments, jewellery/money, precious metals, antiques, heirlooms, computers, personal electronic devices, securities, medications, medical devices, bonds and other similar instruments, business documentation, passports, samples, baggage that was checked based on the conditions of the "Limited Release" tag (LRT), other identification documentation and other items that are not permitted for transport. We recommend that all of our passengers purchase a sufficient amount of travel insurance before travel commences.

Corendon Airlines does not accept liability for personal items that are misplaced or lost in the aircraft or in the airport terminal. All items that are forgotten in the aircraft are taken to the lost and found office at the destination airport.

Corendon Airlines does not accept liability for baggage that was not registered to the name of the flight ticket or boarding pass holder and that does not have a label. If the PIR form was issued for more than one passenger, all of the respective people must sign the reimbursement receipt.

8. Passengers with Special Needs, Disabilities, etc.

8.1. Ill, Disabled or Handicapped Passengers
a. Carriage for ill/disabled passengers shall is only possible upon submission of a written certificate from their personal physician or a public health physician at the airport.
b. Carriage of such passengers is not possible in the following cases:
i. Passengers with infectious diseases such as active tuberculosis, infectious hepatitis, scarlet fever, diphtheria, chicken pox, etc.
ii. Passengers who suffered a heart attack or stroke within the previous eight weeks
iii. Passengers who require connection to compressed air or electrical devices for medical treatment, if the devices are not permitted for transport
iv. Passengers who require and electrical device for oxygen supply during the flight
v. People who are under the influence of drugs or alcohol such that they represent a risk to the aircraft and flight
vi. "Disabled passengers": Passengers who require a physician's approval or permission to confirm their ability to fly so that the airline can offer them carriage.
vii. "Handicapped passengers": All handicapped passengers who are not "disabled" and the carriage of whom does not required a physician's approval or permission.
If passengers do not indicate illness before departure, they flight at their own risk and under their own responsibility.

8.2. Wheelchairs
a. Passenger wheelchairs are transported in the cargo area at no cost as checked baggage, even if they exceed the free baggage limit.
b. Wheelchairs that are equipped with dry cell or wet cell batteries that cannot leak are permitted for transport in the aircraft's cargo area if the battery is removed and affixed securely to the wheelchair and the terminals are electrically isolated.
c. If the wheelchair cannot be loaded, stored, secured and unloaded in a vertical position, the battery must be removed and stored separately in the cargo area. The battery must be placed in a plastic container for transportation purposes. This will prevent the cargo area from contamination and corrosion.

8.3. Pregnant Passengers
a.
Passengers in the 35th week of a pregnancy or beyond are not permitted to fly.
b. Between the 28th and 35th weeks of a pregnancy, passengers require a physician's approval issued no longer than 1 month in advance in order to fly.
c. Pregnant passengers must inform the check-in staff of their pregnancy.
d. The captain has the right to require a new physician's certificate that indicates that the pregnant passenger is healthy and able to fly.

8.4. Children Travelling Alone
a. Children who are not yet 6 years old are not permitted to fly alone.
b. Children between the ages of 6 and 12 are permitted to fly alone if the following conditions are met:
i. The child must be brought to the airport by his or her parent(s) or legal guardian(s).
ii. The respective escort must submit the required travel documentation to the flight personnel or ground handling company as well as a liability exclusion form (releasing responsibility for children less than 12 years old) filled out by the parent(s) or legal guardian(s) or a similar form of the ground handling company.
iii. At the destination airport, the children must be picked up by the person(s) designated by the parent(s) or legal guardian(s).
c. Until their flight is called or they board the aircraft, children travelling alone are in their parents' responsibility. An employee shall accompany the children to the aircraft. The respective escort must remain at the airport until the aircraft has departed.

8.5. Emergency Exit Rows
a.
Passengers who can provide the best possible assistance if the aircraft must evacuated who will not hinder such an evacuation are asked to sit next to the emergency exits. Those who would only hinder the work of the cabin personnel and access to emergency equipment or who would make evacuation of the aircraft more difficult in an emergency must inform the cabin personnel in this regard.
b. The following people are not permitted to set in the emergency exit rows:
i. Passengers with limited mobility, psychological problems or ill or disabled passengers
ii. Passengers with physical or psychological disabilities who cannot move quickly, if necessary
iii. Passengers with eye or ear problems who cannot hear the instructions for carrying out an emergency evacuation
iv. Pregnant passengers
v. Children travelling alone
vi. Passengers accompanying infants and/or children who are not yet twelve years old
vii. Passengers whose physical size prevents them from moving quickly
viii. Prisoners or deportees
ix. Passengers with assistance dogs or pets

9. Carriage of Animals

a. The passenger to whom the animal belongs is responsible for submitting the required animal documentation that includes information regarding rabies vaccination and the health of the respective animal to the responsible agencies in the countries of departure, transit and arrival.

b. Pets in the aircraft cabin: A maximum of 2 pets are allowed for transport in the aircraft cabin if they are kept in a suitable cage that does not exceed a size of 55 x 40 x 20 cm, is water-tight and weighs a maximum of 5 kg together with its contents. The carriage fee per animal/route is EUR 20. One week before departure, a request must be submitted by e-mail (groundoperation@corendonairlines.com) to find out if a reservation was made for a pet.

c. Carriage of pets weighing more than 5 kg in the cargo area: Only one pet may be transported per flight. One week before departure, a request must be submitted by e-mail (groundoperation@corendonairlines.com) to find out if a reservation was made for a pet. The animal documentation that includes information regarding all required vaccinations and the health of the respective animal is also required here as well as a cage. In addition, for each flight a fee of EUR 40 must be paid to the ground handling department or ground handling subcontractor.

d. Assistance dogs are transported at no costs and are not subject to the conditions of carriage. Passengers with visual impairments can take their assistance dogs with them into the cabin. The following conditions apply here:
i. The dog is not allowed a seat and must stay where it does not disturb other passengers. The dog may not be near the emergency exits.
ii. The dog must wear a muzzle.
iii. The passenger must have all of the required health documentation for the animal.
e. If the dog is refused entry into a country, state or region, Corendon Airlines is not liable for the injury, loss, delay, illness or death of this animal.

10. Limitation and Refusal of Carriage

10.1. Right to Refuse Carriage Corendon Airlines can refuse carriage to a passenger and baggage if a risk to security and order exists or if, based on reasonable discretion, Corendon Airlines determines that this measure is necessary:

(a) because the behaviour, the age or the physical or psychological condition of the passenger is such that:
(1) personal assistance is required that Corendon Airlines cannot ensure,
(2) it is inconvenient or offensive to other passengers, or
(3) the passenger represents a risk or danger to other passengers or baggage,

(b) because the passenger does not observe the instructions of Corendon Airlines that are meant to ensure safe, efficient and comfortable carriage for all passengers or to meet the obligations of Corendon Airlines to passengers,

(c) because the passenger demonstrates behaviour that causes doubt with regard to the security and safety of the flight and this behaviour includes threats, abuse or insults,

(d) because the passenger refuses to subject his or her baggage to a security check by Corendon Airlines or by airport or government agents,

(e) because the price of the flight or applicable fees and taxes were not paid or credit agreements between Corendon Airlines and the passenger have not been complied with,

(f) because the customs and/or immigration agencies or other state agencies have informed Corendon Airlines either orally or in writing that the passenger is not permitted to travel. This also includes cases in which the customs and/or immigration agencies or another state agency has distributed negative travel information regarding the passenger.

(g) because the passenger does not have proper, valid travel documents,

(h) because the passenger is attempting to enter into or travel through a country for which he or she does not possess valid entry documentation,

(i) because the passenger destroyed his or her travel documents during the flight,

(j) because the flight ticket submitted by the passenger
(1) is invalid,
(2) was reported as lost, stolen, counterfeited or otherwise suspicious,
(3) is counterfeit,
(4) contains a flight coupon that was modified by someone other than an authorized person,
(5) or the person that submits the ticket cannot prove that he or she is the person listed in the "NAME OF PASSENGER" area. In this case, Corendon Airlines has the right to retain the ticket.

(k) because the passenger has already committed one of the actions or omissions listed above and Corendon Airlines has good reason to believe that this type of behaviour will be repeated,

10.2. A passenger who is refused carriage based on the reasons listed in section 1 or who is refused further carriage during the flight is not entitled to a refund.

11. Liability

The liability of TUIfly.com and Corendon Airlines is based on the provisions specified in the GTCC.

12. Data Protection and Data Security

In the context of contract performance in accordance with federal German data protection law and other legal provisions, TUIfly.com and/or Corendon Airlines are authorized to collect, process, and use personal data. The data are collected, processed, used and transmitted with the use of data processing systems in the context of the purpose of this contract. The data are processed and used for the following purposes in the context of the legal provisions: to make reservations, to purchase flight tickets, to purchase additional services and to process payments, to develop and provide services, to make entry processes and customs processes easier.

In the context of these purposes, TUIfly.com and/or Corendon Airlines are authorized to collect, save, modify, block, delete and use the data and to transmit the data to their own business divisions, to authorized representatives and to those who provide the services listed above by order of TUIfly.com and/or the actual air carrier. Furthermore, TUIfly.com and/or Corendon Airlines is authorized to transmit the passport information and the personal data processed and used in connection with carriage to domestic and foreign agencies (including agencies in the USA and Canada if the respective transmission request of the agency is made due to compulsory legal provisions and is therefore required to meet the conditions of the carriage contract.

13. Amendments

13.1
TUIfly.com reserves the right to amend these STCC Corendon Airlines at any time such that the amendments come into effect at a later date without any obligation to inform the user of these changes. The respective, current version of the STCC Corendon Airlines shall be available on the website from the date it becomes effective. By continuing to use the website after the STCC Corendon Airlines, users declare their consent to these changes.

13.2
No agency, employee or any other third party is entitled to make any amendments and/or addenda to the STCC Corendon Airlines or to waive their applicability.

14. Verbal Agreements

The STCC Corendon Airlines contains all agreements between the passenger and TUIfly.com and supersede all previous agreements, regardless of whether such agreements were made verbally, by electronic means or in writing. In case of conflict between the STCC of Corendon Airlines and the GTCC, the GTCC shall take precedence.

15. Severability Clause

Should any individual provision be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a provision which comes as close as possible to the economic purpose of the invalid provision.

16. Applicable Law and Legal Venue

The contractual relationship between the passenger and TUIfly.com shall be governed by the laws of the Federal Republic of Germany, irrespective of the passenger's nationality. Legal venue for registered business persons, persons who have no general legal domicile inside the country and persons who have transferred their residence or habitual abode to a place outside Germany after conclusion of the contract or whose residence or habitual abode is unknown when the lawsuit is filed, shall be Hanover (Germany). This legal venue agreement shall not apply within the substantive scope of the Warsaw Convention or the Montreal Convention.
