Special Terms and Conditions of Carriage of TUIfly GmbH and TUIfly Vermarktungs GmbH (hereinafter also referred to as TUIfly and TUIfly.com) for air carriage handled by these companies (hereinafter STCC TUIfly)

1. Scope of application

1.1
These Special Terms and Conditions of Carriage (STCC TUIfly) apply to all contracts which are concluded with TUIfly Vermarktungs GmbH, Karl-Wiechert-Allee 23, D-30625 Hannover, Germany for the carriage of passengers and baggage including all related services on the basis of our General Terms and Conditions of Carriage ("GTCC") and where the carriage is executed by TUIfly GmbH and/or TUIfly Vermarktungs GmbH (hereinafter also referred to as TUIfly and/or TUIfly.com) and/or any agents employed in performance of the company's obligations (TUIfly or any such agents hereinafter also referred to as "actual carrier"). Unless otherwise expressly stipulated, these STCC also apply to gratuitous carriage.

2.2
In the following provisions, reference is frequently made to the TUIfly Service Centre. The Service Centre is open from 7.30 to 22.30 (monday to friday) and 8.30 to 21.00 (saturday, sunday and public holiday) Central European Time; the following telephone rates apply:

- In Germany:

3. Carriage of expectant mothers

Expectant mothers are permitted to travel with TUIfly until the end of the 35th week of pregnancy, whereupon travel will be refused. The date in question can be obtained from the passenger’s maternity card, which must be carried at all times. If both the outward and return flight have been booked and the return flight is not until after the end of the 35th week of pregnancy, TUIfly may refuse travel on the outward flight. Expectant mothers travel at their own risk; we recommend that those unsure whether air travel is advisable in their condition should consult a doctor beforehand.

4. Carriage of physically restricted passengers and their aids and appliances

4.1
TUIfly will, through its partner organisations at the airport, provide as much assistance as possible to disabled people or people with restricted mobility for transport to/from the aircraft. This service is free of charge, but passengers requiring the service must notify the TUIfly Service Centre (see Article 2 for contact details) at the time of booking. If this notification is not given at least 48 hours before the published departure time for the flight, this assistance cannot be guaranteed, as TUIfly’s partner organisations at the airport have only limited capacities. Passengers with impaired mobility are permitted to take a folding wheelchair on board free of charge, subject to notification at the time of booking. The TUIfly Service Centre (see Article 2 for contact details) must be notified and must give written confirmation of carriage. Under air safety regulations, the number of wheelchairs carried on a given flight may be restricted. Electric wheelchairs will be carried only if they run on dry batteries. Wet batteries count as prohibited items, cf. TUIfly GTCC 13 (a) (11) and will not be carried by TUIfly pursuant to Clause 1.2.4, IATA Dangerous Good Regulations. Dismantling and modifications of the wheelchair must be made by the passenger / escort before check-in and cannot be made by check-in or boarding personnel or flight crew. The wheelchair must be ready for transport when it is checked as special baggage. TUIfly cannot provide wheelchairs for use on board.

4.2
TUIfly provides carriage for assistance dogs (therapy dogs) in the cabin. The carriage is free of charge. Under air safety regulations, the number of guide dogs carried in the cabin on a particular flight is be restricted. Those wishing to travel with a guide dog must therefore pre-notify the  TUIfly Service Centre (see Section 2 for contact details) and obtain written confirmation. Transportation of guide dogs is free of charge. Strict statutory regulations for the United Kingdom prevent TUIfly from carrying guide dogs on flights to and from the UK. In addition, due to the duration of the flight on longer routes to the Caribbean and Mexico, assistance dogs cannot be transported in the cabin.


4.3 Passengers with fractures and plaster casts
All passengers who would like to travel by air with broken limbs that are in casts have to comply with the following periods before air travel:

• No flights are allowed within 24 hours after a fracture.
• Only flights with a flight time of less than 2 hours are allowed between 24 hours and 48 hours after a fracture.

The cast must be plastered within the first 7 days after a fracture.
We recommend even for fractures that are older than 7 days that the cast is plastered.
Passengers who are traveling with casts on extremities from the hip and upward only need one seat.
Passengers with a leg cast (thigh down to or including the ankle) must purchase
2 seats because the leg must be elevated during the flight and for safety reasons should not be stretched out in the aisle.
For children with leg casts, the number of additional seats to be booked depends on the size of the child.

4.4
In order to comply with applicable safety requirements stipulated in international, Community or national law, or in order to meet the safety requirements of the German civil aviation authority, TUIfly may require that a disabled person or a person with restricted mobility be accompanied by another person who is able to provide the assistance that this passenger needs. Persons accompanying physically restricted passengers are not entitled to free travel; they are required to pay the full fare.

4.5
For passengers who are blind or require a wheelchair, TUIfly keeps seats available where it is easier to board and exit the aircraft. These seats can be reserved at no extra charge for such individuals and for a person accompanying them.
For reasons of safety, emergency exit ‘XL’ seats (EXIT row) will not be assigned to physically or mentally restricted passengers.

4.6
Those travelling with their own oxygen supply must notify the TUIfly Service Centre in advance (see Section 2 for contact details) and obtain written permission/confirmation. Carriage of liquid-oxygen systems is prohibited.

5. Carriage of children and adolescents

5.1
For safety reasons, newborn infants up to the age of 7 days will not be accepted for carriage. Infants (i.e. children under the age of 2) may travel for a reduced fare of EUR 15.00 per flight segment on international flights (GBP 12.00/USD 24.00) and EUR 17.85 on domestic (German) flights, subject to the following terms:

Infants (aged under two (2)) are carried subject to the following conditions:
The airline must be notified in advance that you are flying with an infant and carriage is restricted to 10% of the seats per flight. The infant's age is defined as the age on commencement of the flight, in the case of outbound and return flights, the age on commencement of the return flight. Each adult may be accompanied by one (1) infant only. Infants travel on the lap of their parent or guardian and are secured by means of an additional loop belt, which must be fastened in accordance with the instructions of the crew. Infants are not entitled to a seat of their own unless a separate booking has been made for a child's fare (see Article 5.3), in which case a child's restraint system with TÜV-certification and which is approved by TUIfly must be installed on the seat. The child's restraint system must be provided by the accompanying passenger and is carried free of charge.

5.2. Child restraint system
Both the German civil aviation authority and TUIfly recommend that passengers travelling with infants and children under the age of seven (7) use a TÜV-certified child restraint system that is mounted to a seat booked specially for the child. The following models of these devices are certified for TUIfly:

  • Luftikid Duo
  • Maxi Cosi Mico; manufactured by Maxi Miliaan B.V. ID 8011000571

    (weight: 0-13 kilos, child size: max. 82 cm).

The use of a child restraint system must be registered in our service centre at least two days before departure at 0900 1000 2000 (EUR 0.49/min. from the German landline network, mobile rates may vary). A written confirmation / carriage authorization from TUIfly is required for transporting the child restraint system.

A seat must be booked for carriage of an infant (up to 2 years of age) in a child seat.

On TUIfly long route flights to the Caribbean and Mexico that are carried out on Arkefly aircraft, only those child restraint systems can be used which have the certification listed under item b) above.

5.3
Children under the age of twelve (12) may travel with TUIfly only if accompanied by a person aged 16 or over who takes responsibility for them.

5.4
For unaccompanied minors aged between five (5) and eleven (11), TUIfly offers a special escort service. This costs EUR 30.00 (GBP 24.00 / USD 48.00) in addition to the flight price per child and route on short and mid-length international routes or EUR 60.00 (GBP 50.00 / USD 78.00) on longer routes or EUR 35.70 on German domestic routes. This escort service must be pre-booked by calling the TUIfly Service Centre (see Section 2 for contact details and costs). In all cases, TUIfly goes by the child’s age at the start of the return flight. Unaccompanied minors may not take pets on board (either in the cabin or the hold).

5.5
It should be noted that some countries permit children and adolescents under the age of 18 to leave their home country only on presentation of an authorization form completed by their parents or legal guardians. It is the passenger’s responsibility to carry the required documents with them.

5.6
With the exception of its escort service (which is subject to a charge), TUIfly will not supervise or chaperone passengers and is not liable for the consequences of inadequate supervision or chaperoning.

6. Carriage of baggage

General provisions

6.1 Free baggage and general rules

As far as section 6.2 does not contain different or additional rules for special baggage and excess baggage, the following rules apply for the carriage of baggage on TUIfly flights.

6.1.1 Check-in, carriage and delivery

(a) TUIfly may refuse to accept baggage for check-in unless it is properly and securely packed for safe transportation. For information on packing special baggage, see sections 6.2.1 (l) and 6.2.2 (m). The passenger's name must be on or affixed to the checked baggage. Violating this rule can result in exclusion of liability.

(b) Checked baggage is transported with the same aircraft in which the passenger is transported unless the carrier has concluded that this type of carriage is not possible; in this case, the carrier shall transport the baggage on one it its next departing flights.

(c) The checked baggage is delivered at the destination airport noted in the baggage claim check. The passenger keeps a record of the checked baggage with regard to its weight and number of pieces together with the baggage identification tag. Passengers are obligated to keep the baggage claim checks until the baggage is in their possession and to pick up their baggage as soon as it is made available at the destination airport or at the location at which the flight ended.

TUIfly does not provide shuttle service for baggage to or from the airport. TUIfly does not accept any liability for third party baggage delivery services.


6.1.2 Free baggage, carry-on baggage, maximum weight and dimensions for all flight bookings made by 9 Sept. 2013 as well as for flight bookings made on or after 10 Sept. 2013 departing before or on 30 Apr. 2014

(Important: section 6.1.3 below applies for flight bookings made on or after 10 Sept. 2013 departing on or after 1 May 2014. Section 6.1.4 below applies for flight bookings made on or after 18 March 2014 departing on or after 1 May 2014!)

 

(a) Free baggage rules: If a flight is booked online at http://www.tuifly.com/ TUIfly shall transport one piece of baggage weighing up to 20 kg per passenger as free baggage. This also applies to baggage for children (including infants who do not have their own seats). Those with a TUI Card Gold have a free baggage allowance of 30 kg for the card holder and up to 5 passengers (regardless of age) traveling with the card holder. When an extra seat is booked, free baggage is not included in the booking. Strollers and buggies are transported at no cost.

Starting with the second piece of baggage, TUIfly charges a surcharge for each additional piece of checked baggage. This also applies if the total weight of all of the pieces of baggage does not exceed the free baggage limit of 20 kg. The (discounted) surcharge is 10 EUR per piece of baggage if the respective baggage is booked online at http://www.tuifly.com/ or - for an additional processing fee of 5 euros per booking procedure - by telephone with the TUIfly.com service center (for contact information and costs, see section 2.2) and if the surcharge due is paid in the manner stipulated during the booking. This booking can be made online at http://www.tuifly.com/ or with the TUIfly.com service center during a period up to two hours before departure. If the pieces of baggage for which a surcharge must be paid are booked at the check-in desk at the airport, TUIfly charges a surcharge of 20 EUR per piece of baggage.

For all bookings made before 09.09.2013 with departure date as of 1 May 2014 the same charges as for the Perfect Fare incur.

Please note that the surcharge for an additional piece of baggage must be paid for sun umbrellas and bodyboards that are transported separately (i.e. they are not fastened to a piece of free baggage in such a manner that the applicable dimension and weight rules are met).

The rules for excess baggage for TUIfly flights (see section 6.2) remain unaffected by the surcharges explained above with regard to the second and each further piece of baggage.

(b) Surcharges or processing fees for baggage capacity that has been booked, but is not used by the passenger, cannot be refunded.

(c) Maximum weight and dimensions, carry-on baggage: A single piece of baggage is not permitted to weigh more than 30 kg and the dimensions are not permitted to exceed a maximum of 80 x 65 x 45 cm (special rules apply for special/sports baggage and transportation of animals, see section 6.2 below). In addition, each person is allowed one piece of carry-on baggage (55 cm x 40 cm x 20 cm, weighing up to 6 kg) as well as a laptop computer as free baggage.


6.1.3 Free baggage, carry-on baggage, maximum weight and dimensions for all departures on or after 1 May 2014 with a booking date between 10 Sept. 2013 and 17 March 2014

(Important: section 6.1.2 above applies for all flight bookings made by 9 Sept. 2013 and for those made on or after 10 Sept. 2013 departing before or on 30 Apr. 2014. Section 6.1.4 below applies for flight bookings made on or after 18 March 2014 departing on or after 1 May 2014!)

(a) If a flight is booked online at http://www.tuifly.com/ TUIfly shall transport one piece of baggage weighing up to 15 kg per passenger as free baggage. This also applies to baggage for children (including infants who do not have their own seats). Those with a TUI Card Gold have a free baggage allowance of 30 kg for the card holder and up to 5 passengers (regardless of age) traveling with the card holder. When an extra seat is booked, free baggage is not in-cluded in the booking. Strollers and buggies are transported at no cost.

This applies for exceeding the weight limit; another passenger is not permitted to use the the unused weight capacity. It also applies for each additional piece of checked baggage per passenger, starting with the second piece, even if the total weight of several pieces of baggage does not exceed the free baggage limit of 15 kg. Pieces of baggage that are subject to a surcharge can be booked in a period up to 2 hours before departure at http://www.tuifly.com or - for an additional processing fee of 5 euros per booking procedure - by telephone with the TUIfly.com service center (for contact information and costs, see sec-tion 2.2) and if the surcharge due is paid during the booking. If the baggage is booked at the airport, TUIfly shall charge a higher surcharge. All of the surcharges can be found in the folowing table.

If the actual weight of the first piece of baggage exceeds the free baggage limit or the weight as booked, a surcharge of EUR 10.00 per kg shall be charged at the airport.

In addition, each person is allowed one piece of carry-on baggage (55 cm x 40 cm x 20 cm, weighing up to 6 kg) as well as a laptop computer as free baggage.

6.1.4 Free baggage, carry-on baggage, maximum weight and dimensions for all departures on or after 1 May 2014 with a booking date on or after 18 March 2014

(Important: section 6.1.2 above applies for all flight bookings made by 9 Sept. 2013 and for those made on or after 10 Sept. 2013 departing before or on 30 Apr. 2014. Important: section 6.1.3 above applies for flight bookings made between 10 Sept. 2013 and 17 March 2014 departing on or after 1 May 2014.)

(a) If a flight is booked online as a Perfect fare at http://www.tuifly.com/ or in the Service Center, TUIfly shall transport one piece of baggage weighing up to 20 kg per passenger as free baggage. This also applies to baggage for children (including infants who do not have their own seats). Those with a TUI Card Gold have a free baggage allowance of 30 kg for the card holder and up to 5 passengers (regardless of age) travelling with the card holder. When an extra seat is booked, free baggage is not included in the booking. Strollers and buggies are transported at no cost.

When a flight is booked as a Pure fare no free baggage is included.

If the previously listed free baggage limits associated with the booking of a Pure fare are exceeded, in each instance TUIfly shall require payment of surcharges. This applies for exceeding the weight limit; another passenger is not permitted to use the unused weight capacity. With the Perfect fare, this also applies for each additional piece of checked baggage per passenger, starting with the second piece, even if the total weight of several pieces of baggage does not exceed the free baggage limit of 20 kg. In addition, with Pure fare it applies for each piece of checked baggage.

Pieces of baggage that are subject to a surcharge can be booked in a period up to 2 hours before departure at http://www.tuifly.com or - for an additional processing fee of EUR 5 per booking procedure - by telephone with the TUIfly.com Service Center (for contact information and costs, see section 2) and if the surcharge due is paid during the booking. If the baggage is booked at the airport, TUIfly shall charge a higher surcharge. All of the surcharges are listed in the following table.

Please note that the surcharge for an additional piece of baggage must be paid for sun umbrellas and bodyboards that are transported separately (i.e. they are not fastened to a piece of free baggage in such a manner that the applicable dimension and weight rules are met).

If a flight is booked as a Perfect fare at http://www.tuifly.com/ or in the Service Center, the following surcharges apply:

6.2 Carriage of special/excess baggage

Note: The following rules apply only for carriage with TUIfly airlines. Other rules may apply for special/sports and excess baggage for flights with other airlines. For these flights, only those fees and rules apply that have been confirmed by the respective carrier.


6.2.1 Carriage of special/excess baggage for flight bookings made by 9 Sept. 2013 and for those made on or after 10 Sept. 2013 departing before or on 30 Apr. 2014

(Important: section 6.2.2 below applies for flight bookings made on or after 10 Sept. 2013 departing on or after 1 May 2014!)

Note: The following rules (a) through (l) apply only for carriage with TUIfly airlines. Other rules may apply for special/sports and excess baggage for flights with other airlines. For these flights, only those fees and rules apply that have been confirmed by the respective carrier.

(a) General information:
The carriage of special and excess baggage (i.e. baggage in excess of the free limits, dimensions and weight listed in section 6.1.1 as well as sports baggage, animals and firearms, for example) is required to be booked with TUIfly and is subject to fees. The booking can be made with the TUIfly service center (for contact information and costs, see section 2). You must book the baggage and pay the fee before the flight or we cannot guarantee that it will be transported.

Special and excess baggage weighing more than 50 kg per piece as well as animals (including assistance dogs) shall only be transported if a booking confirmed in writing by TUIfly is presented. This rule is necessary for safety reasons and because there is only a limited capacity for carriage beyond that required for the free baggage.

The available capacity and required compliance with safety regulations are the critical factors involved in decisions regarding the transportation of excess and special baggage. For this reason, it can be restricted to a limited amount or completely excluded from transport.

(b) If special baggage that has not been booked is accepted by the check-in personnel as an exception to the existing rule listed in (a), it is subject to an additional service fee in the amount of EUR 10.00 (8.00 GBP/16.00 USD) that must be paid directly at the airport.

(c) Fees for excess or special baggage capacity that has been booked, but is not used by the passenger cannot be refunded.

(d) Excess baggage costs an additional EUR 10 per kg per route , for long-haul flights in the Caribbean EUR 20 per kg, if an excess baggage package in accordance with the following section (e) has not been booked.

(e) In the period up to 48 hours before the planned departure, an excess baggage package can be booked per person with the TUIfly service center (for contact information and costs, see section 2).

Prices for excess baggage packages (per route and person):

• 5 kilograms EUR 35.00

• 10 kilograms EUR 65.00

• 20 kilograms EUR 100.00

For longer routes to the Caribbean, these are the prices for the excess baggage package (per route and person):

• 5 kilograms EUR 70.00

• 10 kilograms EUR 130.00

• 20 kilograms EUR 200.00

The price for an excess baggage package booked by the passenger but not used cannot be refunded.

(f) Charitable donations
Aid organizations and private citizens support people and animal protection organizations in need. TUIfly provides assistance in the transportation of donated items that are confirmed as such and accompanied by a passenger. (The items must weight at least 20 kg and be packed separately.)
TUIfly requests your understanding that extra baggage cannot be transported for free, even if it is a donation. To at least cover the extra costs for fuel and processing, a special rate is charged for the transportation of donated or humanitarian assistance items. Respective confirmation by TUIfly is required for carriage at the special rate. Please direct requests in this regard to the TUIfly service center (for contact information and costs, see section 2).

(g) Sporting equipment such as diving equipment, skis/snowboards, surfboards, sailboards, etc. up to a maximum weight of 30 kg can be transported on TUIfly flights for a fee of EUR 65 per piece, per route.

Golf baggage and bicycles up to a maximum weight of 20 kg can be transported on TUIfly flights for a fee of EUR 65 per piece, per route. TUIfly does not transport E-Bikes.

The prices listed above apply respectively to one (1) piece of sports baggage per passenger and sport.

The excess baggage rule (see above in sections (d) and (e)) applies for sports baggage that exceeds the quantity or weight limits listed above. Excess sports baggage must be booked online or with the TUIfly service center (for contact information and costs, see section 2) before departure because there is only limited capacity available.

The price for sports baggage capacity that is booked, but not used cannot be refunded.

(h) Provided that musical instruments do not exceed the usual size and weight for hand baggage (dimensions 55 x 40 x 20 cm, weight up to 5 kilos), they can be carried in the cabin. Those wishing to take with them an instrument that exceeds the usual dimensions for hand baggage must contact the TUIfly Service Centre (see Section 2 for contact details and costs) to obtain permission/confirmation. These instruments are to be carried only in the hold and must be properly packed (i.e. in a hard-shell case). If the instrument’s weight exceeds the free baggage allowance, it may be carried in the hold for a flatrate charge of EUR 65.00 on international flights (GBP 44,58/USD 74,31). Cellos, violins etc. can be carried, if and as required, by booking an additional seat in the cabin (subject to security screening).

(i) Life jackets with CO2 cartridges, dive lights and diving scooters must be registered by contacting the TUIfly Service Centre (see item 2 for contact information) and a specific, separate confirmation from TUIfly is required for carriage. To register a diving scooter, the safety data sheet for the battery must be submitted.

(j) The carriage of sporting weapons is restricted and subject to the carrier’s approval and terms. A non-refundable administration fee (per item, per flight segment) of EUR 50 will be charged. The carriage of sporting weapons may be refused without giving reasons.

Those taking ammunition with them are required to pack it securely and separately from the firearm; the airline must be notified, and approval obtained, beforehand. The passenger shall be responsible for compliance with import and export regulations governing the carrying of weapons and ammunition.

(k) Wheelchairs are carried free of charge; as capacity is limited, however, passengers must notify the TUIfly Service Centre (see Section 2 for contact details and costs) and obtain permission/confirmation in advance. TUIfly does not transport E-Bikes. E-Bikes are not considered to be mobility aids.

(l) Special medical baggage for holiday requirements can be carried in the cabin (in which case it must not exceed the maximum dimensions for cabin baggage) and in the hold. Passengers must always notify the TUIfly Service Centre (see Section 2 for contact details and costs) in advance of such baggage, unless the item is to be carried on their person (e.g. crutches). Medical baggage must be packed separately and shown at the check-in desk, where it should be amenable to inspection. Passengers must be able to present a doctor’s certificate on request.

The following kinds of special medical baggage are carried free of charge:

  • Respirators, asthma devices, inhalers
  • Oxygen for the passenger’s own use
  • Catheters
  • Dressings, bandages
  • Walking aids (e.g. crutches and wheeled walkers)
  • Wheelchairs, including accessories (subject to any applicable restrictions)
  • Personal hygiene items (e.g. nappies), stoma
  • Shower/WC seat, ramp for wheelchair users
  • Artificial limbs / prostheses
  • Doctor’s emergency bag
  • Dialysis device, defibrillator, kinesitherapy device, nerve and muscle stimulator
  • Aspirators, irrigators
  • Medication, syringes, special foods

All other medical aids and appliances (such as personal care products and items of clothing) can, if the free baggage allowance is exceeded, be carried subject to payment of the excess baggage charge of EUR 10.00 per kilo, per flight segment.

(m) Packing special baggage:

All special baggage must be packed separately in an adequate and suitable manner for transportation by air and such that it is protected from external and internal damage. TUIfly can reject special baggage if it is not packed in an adequate and suitable manner. Acceptance of baggage despite inadequate packing, which cannot always be recognised upon receipt, does not mean that TUIfly accepts any liability - secure packing remains the responsibility of the passenger, who also accepts the related risk. TUIfly does not accept any liability for damage resulting from inadequate packing.

Bicycles must be packed accordingly; in addition, the handlebars and the pedals must be rotated inward and the chain and gears covered.
Air tanks used for diving must be completely empty.
Dive lights may be transported in carry-on and in checked baggage. The power source (battery) and the illuminant (bulb) must not be connected.

The contents of the sports baggage can be checked by request of the check-in personnel.

6.2.2 Carriage of special/excess baggage for all departures on or after 1 May 2014 with a booking date on or after 10 Sept. 2013

 

(Important: section 6.2.1 above applies for all flight bookings made by 9 Sept. 2013 and for those made on or after 10 Sept. 2013 departing before or on 30 Apr. 2014)

(a) The carriage of special and excess baggage (i.e. baggage in excess of the free limits, dimensions and weight listed in section 6.1.1 as well as sports baggage, animals and firearms, for example) is required to be booked with TUIfly and is subject to fees. The booking can be made with the TUIfly service center (for contact information and costs, see section 2). You must book the baggage and pay the fee before the flight or we cannot guarantee that it will be transported.

 

Special and excess baggage weighing more than 50 kg per piece as well as animals (including assistance dogs) shall only be transported if a booking confirmed in writing by TUIfly is presented. This rule is necessary for safety reasons and because there is only a limited capacity for carriage beyond that required for the free baggage.

The available capacity and required compliance with safety regulations are the critical factors involved in decisions regarding the transportation of excess and special baggage. For this reason, it can be restricted to a limited amount or completely excluded from transport.

(b) If special baggage that has not been booked is accepted by the check-in personnel as an exception to the existing rule listed in (a), it is subject to an additional service fee in the amount of EUR 25.00 that must be paid directly at the airport.

(c) Fees for excess or special baggage capacity that has been booked, but is not used by the passenger cannot be refunded.

(d) Excess baggage costs an additional EUR 10 per kg, per route.

(f) Charitable donations
Aid organizations and private citizens support people and animal protection organizations in need. TUIfly provides assistance in the transportation of donated items that are confirmed as such and accompanied by a passenger. (The items must weight at least 20 kg and be packed separately.)
TUIfly requests your understanding that extra baggage cannot be transported for free, even if it is a donation. To at least cover the extra costs for fuel and processing, a special rate is charged for the transportation of donated or humanitarian assistance items. Respective confirmation by TUIfly is required for carriage at the special rate. Please direct questions in this regard to servicecenter@tuifly.com

(g) Sporting equipment such as diving equipment, skis/snowboards, surfboards, sailboards, etc. up to a maximum weight of 30 kg can be transported on TUIfly flights for a fee of EUR 65 per piece, per route.

Golf baggage and bicycles up to a maximum weight of 30 kilograms can be transported on TUIfly flights for a processing fee of EUR 65 per piece, per route. The prices listed above apply respectively to one (1) piece of sports baggage per passenger and sport. TUIfly does not transport E-Bikes.

The excess baggage rule (see sections (d) and (e) above) applies for sports baggage that exceeds the quantity or weight limits listed above.

6.3 Charges for special baggage/sports baggage and carriage of animals
The following fees apply per route. Registration is handled at http://www.tuifly.com/ or by calling the TUIfly Service Centre for an additional processing fee of EUR 5 per registration procedure (for contact information and telephone charges, see section 2). The baggage fees and the processing fee are not refundable. However, if the booked transportation is cancelled, TUIfly must refund the amount of expenditures saved and / or other possible appropriations if the passenger demonstrates that TUIfly incurred no loss or that the claimed loss is less than the fee paid.

Please note that TUIfly only accepts the sporting items listed below as sports baggage (and they must be packed separately). TUIfly transports other equipment as excess baggage only. TUIfly transports up to 20 kg or 30 kg of sports baggage for a flat fee of EUR 65 per piece, per route. If the piece of sports baggage exceeds 20 kg or 30 kg, the excess baggage fare of EUR 10 per kg, per route applies.

6.4. Carriage of animals
(a) Carriage of animals is subject to payment of a non-refundable administrative fee charged on a per-animal basis, as stated in Section 14.3. If an animal booking is cancelled, however, TUIfly must refund the costs it saved relating to this and/or to possible other uses if the passenger can prove that TUIfly in fact has a much lesser entitlement to reimbursement of costs or of payment.
Those planning to travel with a dog or cat must notify the airline at the time of booking, stating the animal’s weight, and obtain permission/confirmation. The animal must be kept in a secure, suitable travel container, to be provided by the passenger. As the total number of animals per flight is limited, the airline must be notified in advance and permission/confirmation obtained. Animals travelling in the cabin must be kept in a suitable pet travel bag, both flexible and waterproof, with dimensions that do not exceed 55 cm x 40 cm x 20 cm. The animal must not exceed the maximum weight of 6 kilos. The animal’s head must not protrude from the travel bag, and the animal must remain within the container throughout the flight. The container may not, at any time – even if an extra seat is purchased – be placed on the seat. Transportation in the cabin is not possible on long routes to the Caribbean. For carriage in the hold, a stable, secure travel container that does not exceed a maximum height of 83 cm is required. Any pet travel container must, for the animal’s protection, be resistant to internal and external damage during air travel. TUIfly does not assume any responsibility for damage resulting from the inadequacy of the travel container. Guide dogs may travel in the cabin without a container (see also Section 12.2 above).

(b) For safety reasons, those who are allowed to travel with a pet/animal in the cabin are not permitted to sit in the following seats: seats in the first row, seats in the emergency exit row (XL seats) and seats on the aisle.

(c) TUIfly does not accept liability for any damage to the animal’s health sustained as a result of air carriage. Acceptance of the animal for air transportation is subject to the passenger taking full responsibility for the animal. The passenger shall be solely responsible for compliance with all health checks/documentation and requirements/papers necessary for the animal to enter the country of destination. The passenger alone shall be responsible for compliance with all conditions and restrictions associated with the import and export of animals. In general, the passenger is liable for all damage and consequential damage caused by the animal or its transportation. The transport of animals is subject to the provisions of the IATA Live Animals Regulations, which can be made available by the airline on request. In the event of non-compliance with the above conditions of carriage, TUIfly is entitled to refuse to transport the animal. TUIfly is not liable for any additional costs arising therefrom.

(d) TUIfly is unable to carry any animals on flights to and from the UK, owing to the country’s strict statutory requirements. The final decision as to whether and how an animal will be carried lies, on a case-by-case basis, with TUIfly. Passengers intending to travel with animals must notify, and obtain permission/confirmation from, the TUIfly Service Centre (see Section 2 for contact details and costs). Unaccompanied pets, pregnant pets, and pets younger than 12 weeks will not be carried by TUIfly.

6.5 Third-party carriage of special baggage
In the event that TUIfly offers flights with partner airlines for booking online, by telephoning the Service Centre or via a travel agent, special baggage is subject to the provisions of the carrier in question and its regulations governing charges. These items must be pre-booked – either by the customer booking the flight or by the travel agent making the reservation – directly with the relevant carrier.

 

 

7. Responsibility and authority of the Pilot in Command

The Pilot in Command shall at all times be entitled to take all necessary safety measures. In this respect they shall have full decision-making authority with regard to passenger seating as well as the loading, distribution, securing and unloading of baggage. They shall make all decisions concerning whether and how the flight is to be operated, whether and how deviations are to be made from the planned route, and where a landing or intermediate landing is to be made. The same applies if a passenger’s conduct, physical or mental condition is such that an unduly high level of assistance would be required on the part of the in-flight staff.

8. Conduct on board aircraft

8.1 Use of electronic equipment
For safety reasons, the use of all personal electronic equipment is prohibited during take-off or landing. The use of mobile phones is not permitted at any time during the flight. Smoking electronic cigarettes is not allowed. Use of other electronic equipment is subject to the prior permission of the crew.

8.2 Safety measures taken by the crew
TUIfly may take all reasonable and necessary measures required to prevent further consequences of a passenger’s conduct if, either on board or prior to boarding, their behaviour is such that:

a) the aircraft, persons or property on board are placed at risk; or
b) the crew are hindered in performing their duties; or
c) instructions of the crew are not followed, especially with regard to smoking, consumption of alcohol or drugs; or
d) it results in harm or injury to, or an unreasonable burden being placed on, other passengers or crew.

TUIfly is entitled – if necessary and appropriate – to demand that the passenger leaves the aircraft, and may refuse onward carriage to any location, or on all routes operated by TUIfly. Any such offences committed on the aircraft will be subject to both criminal and civil prosecution.

9. Restriction/refusal of carriage

(a) TUIfly is entitled to refuse, or prematurely discontinue, carriage or onward carriage of a passenger or their baggage if one ore more of the following occurs:

(i) Carriage of the passenger would violate applicable law, regulations or requirements of the country of departure or destination, or of a country in whose airspace the flight is (or would be) operated;
(ii) Carriage would impair the safety, order or health of other passengers or crew members or would cause them an unreasonable burden;
(iii) The mental or physical condition of the passenger – including impairment caused by alcohol or drugs – constitutes a danger or risk to the passenger themselves, other passengers, crew members or property;
(iv) The passenger refuses to subject themselves or their baggage to security screening;
(v) The applicable fare, any due taxes or other charges and fees (including any such payment owing from previous flights) has not been paid;
(vi) The passenger does not carry with them all documents required under the entry/exit requirements for the country of destination, is not in possession of valid travel documents, destroys these documents during the flight or refuses, on request, to hand over these documents to crew members against receipt;
(vii) The passenger fails to provide a booking number, or quotes an incorrect one, or the booking for the booking number quoted does not match the identification presented, or the passenger cannot prove that they are the person named in the booking;
(viii) The passenger does not follow security instructions or instructions under the TUIfly house rules;
(ix) The passenger carries baggage that is not permitted;
(x) The passenger has in the past committed one of the above-mentioned acts or omissions which led to the safety, order or health of other passengers, crew members or property of TUIfly being placed at risk, or has been barred by TUIfly from the airline’s flights and premises.

(b) Acceptance for carriage of unaccompanied minors, expectant mothers, disabled persons, sick persons or other individuals requiring special assistance is subject to prior agreement with TUIfly. Subject to the terms of Section 12.4 above, TUIfly may require a disabled person or a person with restricted mobility to be accompanied by another person who is able to provide the assistance this passenger needs.

10. Liability

TUIfly's liability is based on the provisions specified in the General Terms and Conditions of Business and Carriage ("GTCC").

11. Amendments

No agency, employee or any other third party is entitled to make any amendments and/or addenda to these STCC or to waive their applicability.

12. Verbal Agreements

These Special Terms and Conditions of Carriage of TUIfly (STCC) and the General Terms and Conditions of Carriage of TUIfly.com (GTCC) contain the entire provisions of the contract between the passenger and TUIfly.com and supersede all previous agreements, regardless of whether such agreements were made verbally, by electronic means or in writing. In case of conflict between these STCC of TUIfly and GTCC of TUIfly, the GTCC shall take precedence.

13. Severability Clause

Should any individual provision be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a provision which comes as close as possible to the economic purpose of the invalid provision.

14. Applicable Law and Legal Venue

The contractual relationship between the passenger and TUIfly shall be governed by the laws of the Federal Republic of Germany, irrespective of the passenger's nationality. Legal venue for registered traders, persons who have no general legal domicile inside the country and persons who have transferred their residence or habitual abode to a place outside Germany after conclusion of the contract or whose residence or habitual abode is unknown when the lawsuit is filed, shall be Hanover (Germany). This legal venue provision shall not apply within the substantive scope of the Warsaw Convention or the Montreal Convention.
