Special Terms and Conditions of Carriage of TUIfly Vermarktungs GmbH (hereinafter referred to as TUI fly) for air carriage handled by Air Cairo (hereinafter Air Cairo)

1. Scope of application

1.1
These Special Terms and Conditions of Carriage apply to all contracts for flights or services which are entered into with TUI fly on the Basis of the General Terms and Conditions of Carriage ('GTCC') and where this contract is executed by Air Cairo.

1.2
TUI fly is the contracting carrier as defined in legislation governing carriage by air and the party to the contract with the passenger. TUI fly shall have the carriage to which the passenger is entitled handled by Air Cairo. Air Cairo is the actual carrier as defined in legislation governing carriage by air.

1.3
In Addition to these Air Cairo STCC, the GTCC of TUI fly also apply. In case of conflict between these Air Cairo STCC and the GTCC, the GTCC shall take precedence.

3. Additional services

4. Tickets

4.1 General Information

4.1.1 Carriage is only provided to the passenger named in the electronic ticket; the passenger may be required to provide the according identification. The following definitions apply for the purposes of these STCC: “Electronic ticket” refers to an electronic entry/coupon in Air Cairo reservation system (and, if applicable, in the reservation system(s) of one or more other airlines) with which a flight booking is registered, for which Air Cairo or TUI fly issued an electronic ticket receipt or itinerary, and these conditions and all of the information contained herein are part of the booking. “Carriage” is the same as “transport” and, based on these conditions, is subject to the liability provisions and limitations specified in the Warsaw Convention or the Montreal Convention, unless the carriage is not “international” in accordance with one of these conventions. As far as it does not contradict the conditions listed above, carriage provided by a carrier and other services provided by that carrier are subject to the following:

a) the provisions contained in the electronic ticket receipt/itinerary
b) the applicable fares
c) the STCC Air Cairo and the GTCC

4.1.2 Ticket as evidence of a contract
Carriage is only provided to the passenger named in the electronic ticket and the passenger may be required to provide the according identification. Carriage is only provided for those who have a valid booking confirmation (a “ticket” in accordance with the Montreal and Warsaw Conventions); each of these persons must be named as a passenger in the booking confirmation.

4.1.3 Tickets are not transferable:
a) If the ticket is presented by someone other than the person named and entitled to carriage, even for the purposes of obtaining a refund, Air Cairo does not accept any liability with regard to the respective, entitled person if Air Cairo provides carriage or a refund in good faith to the person who presents the ticket.
b) Air Cairo reserves the right to check the identity of passengers.

4.1.4 The ticket is and remains the property of Air Cairo at all times.
The ticket is equivalent to evidence of a carriage contract concluded between TUI fly and the passenger. The contractual conditions contained in the ticket constitute a summary of these STCC Air Cairo.

4.1.7 The electronic ticket purchased by the passenger is only valid for the carriage of the named customer from the place of departure to the destination on the date named with the listed flight number. If the passenger wishes to change the flight, he or she must request information from TUI fly (see the contact information listed in section 2.1) in advance.

4.2 Name and address of the air carrier
Air Cairo may be abbreviated on the ticket by using the Air Cairo airline code (or otherwise). The address of Air Cairo is listed in these conditions of carriage (see section 2.1).

5. Booking

5.1 Communicating special circumstances
If the passenger has an illness or other difficulties for which he or she requires medical assistance when boarding or disembarking from the aircraft or during the flight itself (e.g. circumstances listed in
section 8), the passenger must inform TUI fly (for contact information, see section 2.1) at the time of the booking. When arriving in or departing from certain countries, the requirements listed in section
5.1.3 may not apply based on the respective laws, and the passenger should ask TUI fly (for contact information, see section 2.1) how the requirements differ.

5.2 Personal information
Passengers acknowledge that TUI fly makes personal information available to Air Cairo for the following purposes: To complete the booking, to purchase the ticket and selected services, to develop and provide services, to carry out entry formalities and transfer this information to the responsible government agencies. The passenger authorizes Air Cairo to forward this information for these purposes only to Air Cargo’s own offices, authorized agents, agencies, other airlines and those who provide the services listed above.

5.3 Seats
Air Cairo attempts to fulfil seat requests. However, Air Cairo cannot guarantee any specific seats. Air Cairo reserves the right to assign new seats, even after passengers have boarded the plane. This may be required for justifiable reasons, such as operation or safety.

6. Check-in and boarding

6.1
Every airport has different check-in deadlines. Air Cairo recommends that passengers inform themselves in this regard in advance and to comply with these deadlines. Air Cairo reserves the right to cancel the booking for non-compliance with the given check-in deadlines. For information regarding the check-in deadlines for Air Cairo flights, see the Air Cairo flight schedule or the Air Cairo web site.

6.2
Passengers are obligated to arrive at the gate for boarding at the latest by the time specified by Air Cairo at check-in.

6.3
Air Cairo is entitled to cancel the booking and unload baggage if the passenger does not arrive at the gate in a timely manner for boarding.

6.4
Passengers are solely responsible for complying with the applicable laws and requirements for the countries of departure, transit and destination, the applicable provisions and the respective instructions given by Air Cairo. Air Cairo does not accept any liability with regard to the passenger in terms of procuring the necessary documentation or complying with these legal provisions, requirements or instructions, regardless of whether these were communicated orally, in writing or in another form, or for the consequences that result if the passenger does not procure this documentation or does not comply with these legal provisions, requirements or instructions.

6.5
Passengers are obligated to subject themselves to a security check according to the rules that apply at the place of departure.

7. Limitation and refusal of carriage

7.1 Right to refuse carriage

7.1.1 Air Cairo can refuse to transport passengers or baggage for specific reasons at its own discretion, if Air Cairo has informed the passenger in writing that the passenger or the baggage will no longer be transported by Air Cairo flights starting from the time of the written notification. In this case, the liability accepted by Air Cairo is limited exclusively to the right to a refund.

7.1.2 In addition, Air Cairo can refuse to transport the passenger and/or baggage on Air Cairo flights (without having to inform the passenger in advance and even if the passenger is in possession of a valid ticket and a boarding pass), if one of the following instances has occurred or if Air Cargo must assume that it will:

7.1.2.1 This measure must be taken for regulatory or legal reasons

7.1.2.2 The passenger and/or the transportation of the baggage could endanger the security or health of other passengers or the Crew, or represents a significant impairment to well-being, or is disturbing to other passengers

7.1.2.3 The passenger’s mental or physical condition, including limitations caused by alcohol or drugs, represents a hazard or risk to the passenger him or herself, to other passengers, or other people’s property

7.1.2.4 The passenger’s mental or physical condition, including limitations caused by alcohol or drugs, could cause a significant amount of annoyance or unpleasantness among other passengers on board if the passenger were allowed to continue his or her journey in the class booked or accepted for this trip

7.1.2.7 The passenger is evidently not in possession of valid travel documentation or the documentation was not obtained in a timely manner or the passenger does not meet the necessary Visa requirements from Air Cairo’s perspective, or the passenger wants to enter a country which he or she is only entitled to transit through or for which he or she does not have valid entry documentation (or does not meet Visa requirements), or the passenger destroys his or her travel documentation during the flight or between check-in and boarding, or refuses to provide this documentation to the crew upon request in exchange for a receipt, or refuses to allow Air Cairo to make copies of it

7.1.2.8 The passenger presents a ticket that was or seems to have been procured illegally, was purchased from somewhere other than Air Cairo or its authorized agents, was reported as lost or stolen, or is forged or the passenger cannot prove that he or she is the person named in the ticket

7.1.2.9 The passenger presents a ticket that was issued in another way than that used by Air Cairo or its authorized representatives or was modified or made unrecognizable or damaged

7.1.2.10 The passenger disregards or impedes the implementation of the Air Cairo safety instructions, whether before boarding or on board the aircraft, or disregards or impedes instructions given by the ground or flight crew as part of their duties, or tampers with the aircraft, the aircraft’s equipment or parts of it, or makes threatening remarks

7.1.2.11 The passenger behaved improperly on a previous flight and Air Cairo must assume that this behavior could occur again

7.1.2.12 The passenger has already acted or failed to act in a manner listed above on an Air Cairo flight or a flight by another air carrier and Air Cairo must assume that this behavior could occur again

7.1.2.13 The passenger commits a crime during check-in or other boarding or disembarking procedures, on board the aircraft before take-off or on board the aircraft or when using an Air Cargo service

7.1.2.14 That the passenger makes threatening, derogatory, insulting or abusive remarks or behaves in a threatening, improper or insulting manner toward the ground or flight crew before or after boarding the aircraft, when disembarking or on board the aircraft before take-off

7.1.2.18 The passenger has forgotten or refuses to provide Air Cairo with information that the passenger has, which an administrative agency has requested Air Cairo to provide by law, or Air Cairo has the impression that the respective information is false or misleading

7.1.2.19 For medical reasons, the passenger is not fit to fly

7.1.2.20 The passenger is in illegal possession of drugs or Air Cairo must assume that the passenger is in illegal possession of drugs

8. Special assistance

The transportation of unaccompanied children, disabled persons, pregnant women, ill persons and other that require special assistance must be agreed upon in advance with Air Cairo. Passengers with disabilities who have informed Air Cairo upon booking of their special requirements that were accepted by Air Cairo cannot be refused carriage at a later time due to their disabilities or special requirements.

8.1 Carriage of children
Unaccompanied children between the ages of 2 and 11 may only be transported if the following requirements are met. Unaccompanied children can only be transported following consultation with Air Cairo in advance and depending on the age of the child. Children under the age of 2 will not be transported as unaccompanied minors by Air Cairo. The rules regarding the transportation of unaccompanied minors can be requested from Air Cairo (for contact information, see section 2.2).

8.2 Ability to fly
8.2.1 Before boarding the aircraft, a passenger’s health must be such that he or she is able to fly. A medical examination is not required unless Air Cairo must assume or should know, upon reasonable observation, that the passenger has a health condition that can become worse during the normal operation of an aircraft, or could pose difficulty for the passenger if he or she cannot receive medical assistance before the flight has come to an end. In this case, the passenger is obligated to getprofessional medical advice before he or she commences travel with Air Cairo, and must submit a statement by a qualified physician at the latest by 48 hours before the flight that confirms that the passenger is able to travel on all of the booked flights. When arriving in or departing from certain countries, the requirements listed in section 8.2 may not apply based on the respective laws, and the passenger should ask Air Cairo (for contact information, see section 2.2) how the requirements differ.

8.2.2 If the passenger becomes ill for any reason during the flight (with the exception of reasons for which Air Cairo or its authorized agents are responsible or due to pregnancy), any costs incurred by Air Cairo due to treatment on board the aircraft, ground transportation or treatment by third parties must be repaid to Air Cairo.

 

9. Baggage

9.1 Free baggage
Passengers can bring a limited amount of baggage along as free baggage. Information about free baggage and size limitations can be found on the electronic ticket/itinerary, and the conditions available
at www.tuifly.com website on the day of the flight apply.

9.2 Excess baggage
A fee is charged for transporting additional baggage that exceeds the free baggage limit. The Air Cairo rates for excess baggage can be found on the Air Cairo web site. The transportation of more than 100 kilograms of excess baggage and/or bulky items (such as bicycles or wheelchairs) must be registered in advance with Air Cairo. If no registration is made, Air Cairo reserves the right to refuse carriage of excess baggage and/or bulky items. Excess baggage that is to be sent by air freight must be checked in at least 24 hours before flight check-in.

9.3 Items not accepted as baggage
9.3.1 The following items are not allowed to be transported in baggage:

9.3.1.1 Objects that can endanger the aircraft, persons or objects on board the aircraft as listed in the dangerous materials rules of the ICAO (International Civil Aviation Organization) and the IATA (International Air Transport Association) and objects listed in the STCC Air Cairo (more information is available by request - for contact information, see section 2.2).

9.3.1.2 Objects that are prohibited from transportation according to the applicable regulations of the country of departure or arrival

9.3.1.3 Objects that are reasonably termed unsuitable for carriage by Air Cairo because they are dangerous or unsafe or, due to their size, weight, shape or type are unsuitable, or are fragile or perishable; the aircraft type in use must be considered here. A list of unacceptable objects can be supplied by request (for contact information, see section 2.2).

9.3.2 Unchecked baggage is not allowed to contain firearms, replicas of firearms, toy firearms (made of plastic or metal), or objects that look like firearms or could be reasonably be assumed to be firearms, tools, ammunition, detonators, fuses, grenades, gas containers and gases such as butane, propane, acetylene or oxygen), explosives or items that contain explosives, catapults, crossbows, harpoons, shocking devices, cattle prods, ballistic conducted energy weapons (taser), lighters that look like firearms, fireworks, signal rockets and other pyrotechnical devices (including small fireworks, firecrackers and toy caps), igniters, smoke generating canisters or cartridges, flammable liquid fuel (e.g. petrol/gasoline, diesel, lighter fluid, alcohol, ethanol, spray paint, turpentine and paint thinner, alcoholic beverages with more than 70% vol., acids and alkalis (e.g. spillable ‘wet’ batteries), corrosive or bleaching substances (e.g. mercury, chlorine), disabling or incapacitating sprays (e.g. pepper spray, tear gas), radioactive material (e.g. medicinal or commercial isotopes), poisons, infectious or biological hazardous material (e.g. infected blood, bacteria and viruses), material capable of spontaneous ignition or combustion, fire extinguishers, tableware, scissors, corkscrews, nail files, knives with blades of any length, knitting needles, letter openers, batons or clubs, razor blades (excluding safety or disposable razors with blades enclosed in cartridge), billiard cues of any kind, injection needles (unless they are required for medical purposes and a medical certificate with the confirmation of the illness has been submitted), hard sporting balls or martial arts equipment.

9.3.3 Firearms (including replicas and toy firearms), air pistols, firearm parts and ammunition that are not being transported for hunting or sporting purposes are excluded from carriage as baggage. Firearms and ammunition for hunting and sporting purposes can be accepted as checked baggage at our discretion. Firearms must be unloaded, secured with a safety lock, and packed in a suitable manner.The transportation of ammunition is subject to the regulations of the ICAO and IATA in accordance with section 9.3.1.1.

9.3.4 Firearms, such as antique guns, swords, knives and similar items can be accepted at our discretion as checked baggage, but are not allowed on board. The respective items will be given to airport security personnel for transfer to the passenger.

9.3.5 Checked baggage should not contain cash, jewelry, gems, computers, personal electronic devices, saved data, medicine or medical devices that could be used during the flight or during travel or that cannot be quickly replaced in case of loss or damage, house or vehicle keys, negotiable documents, transferable securities or other valuable items, business documentation, passports or other identification documents.

9.3.6 If the passenger has items listed in sections 9.3.1, 9.3.2, 9.3.3 and 9.3.5 in their baggage, despite the fact that they are prohibited, Air Cairo does not accept any liability for damage or loss.

9.3.7 Air Cairo recommends that passengers not place fragile or perishable objects in their checked baggage.

9.4 Right to refuse carriage
9.4.1 In accordance with sections 9.3.2 and 9.3.3, Air Cairo refuses to carry the items listed in section 9.3. Air Cairo can refuse continued carriage of these items if their presence is determined, regardless of if and when Air Cairo is informed of them or they are discovered by Air Cairo (for contact information, see section 2.2).

9.4.2 Air Cairo can refuse the carriage of baggage if an item can be reasonably assumed by Air Cairo to be unsuitable for transport based on its size, shape, weight, contents or type for reasons of safety,
operation or the well-being of the passengers. Information regarding unacceptable objects can be supplied by request.

9.4.3 Air Cairo can refuse to transport baggage if it is not properly packed in suitable containers. Information regarding packing procedures and containers that are not accepted by Air Cairo are
supplied by request (for contact information, see section 2.2).

9.4.4 Excess baggage can be transported by a later flight if Air Cairo was not contacted in advance regarding its carriage.

9.5 Right to search
For safety reasons, an examination and scan of the passenger and an X-ray examination and check of the baggage is performed to determine if items listed in section 9.3.1 or firearms and ammunition that was not presented to Air Cairo in accordance with section 9.3.2 is in the passenger’s possession or baggage. If the passenger does not consent to this request, Air Cairo can refuse to transport the passenger or the baggage. If necessary, the baggage shall be examined by customs or another administrative department in the presence of the passenger. Air Cairo does not accept liability for damage that occurs in the context of such an examination. The passenger is obligated to allow security checks, examinations and scans to be performed by Air Cairo, check-in partners, airport personnel, police or military officers. If the passenger refuses to allow these examinations, Air Cairo shall refuse to transport the passenger and/or the baggage.

9.6 Checked baggage
9.6.1 When passengers check the baggage that they wish to have transported, Air Cairo takes responsibility for it and issues a baggage claim check for each of the passenger’s checked pieces of baggage.
Unchecked baggage that passengers wish to take on board with them and is given to Air Cairo for storage in the cargo area upon request during boarding is considered as part of the checked baggage
listed on the baggage claim check.

9.6.2 The name of the passenger or other personal identification (including a contact telephone number) must be located on the checked baggage.

9.6.3 If possible, the checked baggage will be transported in the same aircraft as the passenger, unless Air Cairo decides, for safety or operational reasons, to transport it on another flight. If the baggage is
transported on another flight, Air Cairo shall deliver it to the address provided by the customer, unless there are legal regulations at the destination that require the passenger to be present for customs
procedures or if, due to its size, weight or type or due to non-compliance with the conditions of carriage, the baggage is transported on another flight.

9.6.4 The baggage shall not be transported by Air Cairo if the passenger does not board the aircraft into which it was loaded or if the passenger leaves the aircraft before departure or at a stopover and does
not board the aircraft again, unless it was decided not to transport the baggage in the same aircraft as the passenger.

9.6.5 The passenger must ensure that the checked baggage is packed well enough and secured to withstand the normal circumstances of flight transportation (with the exception of normal wear and
tear).

9.7 Carry-on baggage (baggage that is not checked)
9.7.1 Air Cairo is entitled to specify the maximum dimensions and/or weight of the baggage that passengers are allowed to bring on board the aircraft. If Air Cairo has not made any specifications, carry-on
baggage must still be able to fit below the seat in front of the passenger or in the baggage compartments intended for this purpose. If the carry-on baggage cannot be stowed properly, if it is
too heavy or is otherwise considered dangerous, the passenger will be requested to check it with Air Cairo and it will be transported as checked baggage, subject to a fee.

9.7.2 Items that are not suitable for transport in the cargo area (e.g. fragile musical instruments) and that do not meet the requirements in section 9.7.1 are only allowed to be transported in the cabin if the
passenger registers them in advance with and Air Cairo confirms the registration. In certain circumstances, a fee will be charged for this service (for contact information, see section 2.2).

9.8 Return of checked baggage
9.8.1 In accordance with section 9.6.3, passengers are obligated to pick up that baggage as soon as it is made available at the destination or stopover. If the baggage is not picked up within an appropriate
time period, Air Cairo can require that the passenger pay a storage fee. If the checked baggage is not picked up within three (3) months after it was made available, Air Cairo can dispose of it without
incurring any liability.

9.8.2 Only the person holding the baggage claim check issued at check-in and the and baggage identification tag is entitled to pick up the checked baggage. The baggage is also released without
presentation of the baggage identification tag if the baggage claim check is submitted or the baggage is identified in another manner.

9.8.3 If the person picking up the baggage cannot present the baggage claim check and baggage identification tag, Air Cairo shall only release the baggage to this passenger if his or her entitlement to
the baggage is proven sufficiently and satisfactorily. By request, the respective passenger must also ensure to a reasonable degree that Air Cairo shall be compensated for any loss, damage or expenses
associated with checking the baggage.

9.8.4 In case of loss, delay or damage to the baggage, the passenger must inform Air Cairo immediately upon arrival. If the baggage is picked up without objection by the person listed on the baggage claim
check, this serves as evidence that the baggage was delivered in good condition and according to the contract for carriage.

9.9 Animals
Air Cairo does not transport any live animals in the cargo area if these are checked as baggage or freight.

9.9.1 Air Cairo only allows small animals, such as cats, dogs or birds to be transported in the cabin for a surcharge (for contact information, see section 2.2).

9.9.2 Preparation for transport and booking must be completed before the date of travel.

9.9.3 Air Cairo accepts such animals for transport in the cabin under the following conditions:

9.9.3.1 Animals in cages must be under control, so that they do not disturb other passengers.

9.9.3.2 No more than three cages can be accepted for transport in the cabin.

9.9.4 The passenger is responsible for complying with legal provisions in the countries of departure, transit and destination.

9.9.5 Guide dogs that accompany disabled persons are transported for free on board, as long as the applicable legal provisions are complied with and the animals are registered in advance.

9.10 Items confiscated by airport security personnel
Air Cairo is neither responsible nor liable for items that are taken from baggage or kept by airport security personnel for safety or security reasons.

9.11 Carry-on baggage rules
Carry-on baggage must be able to fit below the seat in front of the passenger or in the baggage compartments intended for this purpose. The transportation of items on board that are larger than the greatest dimensions specified on the Air Cairo web site can be refused. If ground personnel do not accept the carry-on baggage, excess baggage fees are charged per piece of baggage. The baggage is transported in the cargo area and a receipt for checked baggage shall be issued. At certain airports, limitations apply with regard to the transportation of liquids, aerosols and gels in carry-on baggage. Passengers should inform themselves at the departure airport as to whether or not safety limitations
apply.

 

 

10. Flight schedules, delays, cancellation of flights

10.1 Flight schedules
10.1.1 The flight times listed in the flight schedules can change between the time they are published and the actual date of departure. Air Cairo does not make any guarantees in this regard and the times are not
part of the concluded contract.

10.1.2 Before the booking is accepted, passengers are informed by an authorized agent regarding the flight times that apply for the specified point in time, which are also listed on the ticket. It can happen that
Air Cairo must change the flight time listed after the ticket is issued.

10.2 Delays, cancellations, rerouting, etc.
10.2.1 Air Cairo takes all of the appropriate measures necessary to prevent delays in the transportation of people and baggage. In the course of taking these measures and in order to prevent the cancellation
of flights, in exceptional situations Air Cairo can have carriage carried out in their name by another airline and/or with a different aircraft without any obligations on their part.

10.2.2 As long as nothing else has been included in the agreement, the following applies: If Air Cairo cancels a flight, does not carry out the flight within a reasonable time period according to the flight schedule,
or does not fly to the destination, Air Cairo shall do one of the following based on the passenger’s
preference:

10.2.2.1 Ensure that the passenger is transported on the next possible, scheduled Air Cairo flight on which a seat is available at no further charge and, if necessary, the validity of the ticket shall be extended, or

10.2.2.2 Ensure that the passenger be transported within a reasonable period of time on another Air Cairo flight, a flight by another airline, or in another agreed upon manner in an agreed upon class of
carriage to the destination listed in the ticket

10.2.2.3 If it is not possible to transport the passenger to the destination listed in the ticket within a reasonable time period using Air Cairo’s own services and the passenger does not wish a refund, Air Cairo can use
the services of another air carrier specified by Air Cairo in order to transport the passenger to the destination (as long as seats are available in the same class of carriage).

10.2.2.4 If one of the circumstances listed in 10.2.2 arises, as long as nothing else has been included in the agreement, the options listed in 10.2.2.1 through 10.2.2.3 are the only remedies available to the
passenger and Air Cairo does not accept any further liability with regard to the passenger.

10.2.2.5 If an Air Cairo flight was to be carried out from an airport within the EU and was cancelled or delayed by at least three (3) hours, the passenger can claim certain rights, about which Air Cairo shall inform
the passenger as necessary.

11. Conduct on board the aircraft

11.1 General information
On board the aircraft, passengers may never behave in such a way that they endanger or threaten the aircraft, a person or a person’s property on board (either by threatening jokes or otherwise); that they impede, delay or threaten the crew in the implementation of their duties; that they do not follow or comply with instructions or orders made by the crew, either orally or in writing, including rules regarding smoking, the consumption of alcohol or drugs, the safety or use of electronic devices; or that the passenger’s behavior causes or could cause discomfort, danger, inconvenience, damage or injury to other passengers, the crew or property. If, based on Air Cairo’s assessment, passengers on board behave in one of the ways listed above, Air Cairo is entitled to take the necessary measures to prevent this behaviour, up to and including the use of handcuffs. Air Cairo can demand that the passenger leave the aircraft and refuse to transport the passenger to any destination without incurring any liability, and the passenger can be subjected to legal action regarding any offences committed on board.

11.2 Electronic devices
For safety and security reasons, Air Cairo can prohibit or limit the use of electronic devices on board,including mobile telephones, laptops, computers, mobile recording devices, portable radios, CD players, electronic toys or devices with a transmission function, including remote control toys and walkie talkies.The use of hearing aids and pacemakers is permitted.

11.3 Non-smoking flights
All Air Cairo flights are non-smoking flights. Smoking is prohibited in all areas of the aircraft.

11.4 Seat belt requirement
When passengers are sitting in their seats in the aircraft, their seat belts must be fastened at all times.

11.5 Rerouting surcharges and other costs
If, as a result of passenger behavior as listed in section 11.1, Air Cairo uses its obligatory discretion and decides to reroute the aircraft in order to remove the passenger and/or baggage from the aircraft, Air Cairo has the right to require the passenger to pay all of the costs incurred due to the detour.

12. Agreement with regard to additional services

12.1
If Air Cairo, in agreement with a third party, offers other services other than air transportation, or if Air Cairo issues a ticket or voucher in connection with carriage or services (other than air transportation) which are provided by the third party, such as hotel reservations or rental cars, Air Cairo functions in these cases as an intermediary only. The terms and conditions of business of the third party apply.
12.2
If Air Cairo also provides the passenger with land transportation, other conditions may apply with regard to such transportation. Passengers can request these conditions from Air Cairo (for contact information, see section 2.2).

13. Administrative procedures

13.1 General information
13.1.1 Passengers are responsible for obtaining all required travel documents and Visas as well as complying with all of the laws, provisions, instructions, regulations and travel requirements of the countries
departed from, transited through or arrived in.

13.1.2 If a passenger is not able to obtain these documents or Visas, or does not follow the laws, provisions,instructions, regulations, rules or orders, Air Cairo is not liable for the resulting consequences.

13.2 Travel documents
Before travel commences, all of the documents with regard to exiting, entry, health and other documents required by laws, provisions, instructions or other regulations required by the respective countries must be presented, and the passenger must allow Air Cairo to make and keep copies of them. Air Cairo reserves the right to require the passenger to present all of this documentation at any time during the flight, and to refuse to transport the passenger and baggage if the passenger does not follow these instructions, or if it becomes clear that travel documentation is not in order, even if the passenger has already begun or completed part of his or her trip before Air Cairo determined that the passenger has not met the requirements of section 13.2.

13.3 Entry ban
If a passenger is prohibited from entering a country, the passenger is responsible for paying the fine or fee charged to Air Cairo by the respective government as well as the costs for transportation out of this country. The costs for transportation at the location of the ban or the prohibited entry shall not be refunded by Air Cairo.

13.4 Passengers responsible for fines, detention costs, etc.
If, because a passenger has not followed the laws, directives, orders, requirements or other travel regulations of respective countries or does not present the required documents and Air Cairo is required to pay a fine or penalty, transfer fees or ancillary costs or to make other expenditures, the passenger is obligated to reimburse Air Cairo, at its request, for all previously paid amounts and incurred costs. Air Cairo is allowed to charge these amounts or costs against the value of the unused portion of the Transportation left on the ticket or all of the funds in Air Cairo’s possession. The amount of the penalty or fine can vary by country and can be greater than the amount the passenger paid for the ticket.

13.5 Customs check
If necessary, customs authorities or other governmental agents must carry out a baggage check. Air Cairo does not accept any liability for any losses or damage that occurs during such a check or due to the failure to fulfil this requirement.

13.6 Security check
Passengers are obligated to allow all security checks carried out by the government, the airport authorities, the airline or by us.

13.7 Transfer of passenger information
In order to meet the requirements of the contract for carriage, Air Cairo is authorized to forward the personal information as well as booking information regarding the flight to domestic and international agencies (e.g. to the USA and Canada, etc.) if these agencies require it from Air Cairo due to mandatory legal regulations and provisions.

13.8 Confiscated travel documents
Air Cairo shall not accept any liability for returning the travel documentation, identification documents or tickets that were confiscated by another airline or governmental agency or other agency.

14. Time limit for claims and actions

14.1
Damage claims Acceptance of checked baggage by its owner without objection when it is handed over serves as sufficient evidence that the baggage was released in its proper condition and according to the contract for carriage, as long as the passenger cannot prove otherwise. If a passenger wishes to make a complaint or assert a claim for damage to the checked baggage, the passenger must notify Air Cairo of the damage immediately upon discovering it, at the latest within seven (7) days after the baggage is received. If a passenger wishes to make a complaint or assert a claim due to delay in receiving the checked baggage, the passenger must notify Air Cairo within twenty-one (21) days after the baggage is received. All notification must be made in writing.  

14.2
Time limit for actions Any right to claims for damages expire if no legal action is taken within two years after the date of arrival at the destination, or the day on which the aircraft was scheduled to arrive, or the day on which carriage was interrupted. The manner of calculation for this date of expiration is determined by the law of the jurisdiction in which the legal case shall be decided.

15. Other conditions

The transportation of passengers and baggage is carried out in accordance with other specific provisions and conditions that apply for Air Cairo or that were specified by Air Cairo. These important provisions andconditions, which can vary, include the following, among others:

(i) The transportation of minors travelling alone, pregnant women and ill passengers
(ii) Limitations with regard to the use of electronic devices and items
(iii) Consumption of alcoholic beverages on board
The rules regarding these cases are available from Air Cairo upon request (for contact information, see section 2.2).

 

16. Liability in case of damage

The liability of TUI fly and/or Air Cairo is based on the rules of the GTCC.

17. Verbal agreements

These STCC Air Cairo and the GTCC TUI fly contain the entire provisions of the contract between the passenger and TUI fly and supersede all previous agreements, regardless of whether such agreements were made verbally, by electronic means or in writing. In case of conflict between these Air Cairo STCC and the GTCC, the GTCC shall take precedence.

18. Invalidity of one or more provisions

Should any individual provision be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a provision which comes as close as possible to the economic purposeof the invalid provision.

19. Applicable law and place of jurisdiction

The contractual relationship between the passenger and TUI fly shall be governed by the laws of the Federal Republic of Germany, irrespective of the passenger's nationality. Legal venue for registered traders, persons who have no general legal domicile inside the country and persons who have transferred their residence or habitual abode to a place outside Germany after conclusion of the contract or whose residence or habitual abode isunknown when the lawsuit is filed, shall be Hanover (Germany). This legal venue provision shall not apply within the substantive scope of the Warsaw Convention or the Montreal Convention.
