Special Terms and Conditions of Carriage of TUIfly Vermarktungs GmbH (hereinafter referred to as TUI fly) for air carriage handled by Vueling Aktiengesellschaft (hereinafter Vueling)

1. Scope of application

1.1
These Special Terms and Conditions of Carriage apply to all contracts for flights or services which are entered into with TUI fly on the basis of the General Terms and Conditions of Carriage (‘GTCC’) and where this contract is executed by Vueling S.A. (hereinafter referred to as Vueling).
1.2
TUI fly is the contracting carrier as defined in legislation governing carriage by air and the party to the contract with the passenger. TUI fly shall have the carriage to which the passenger is entitled handled by Vueling. Vueling is the actual carrier as defined in legislation governing carriage by air.
1.3
In addition to these STCC Vueling, the GTCC of TUI fly also apply. In case of conflict between these STCC Vueling and the GTCC, the GTCC shall take precedence.

3. Additional services which can be booked directly with Vueling; baggage fee for checked baggage

Current fees for additional services that must be booked directly through Vueling can be found on the web site for Vueling or you can call the Vueling Call Center directly (for contact information, see section 2.2).

 

4. Carriage of expectant mothers

Vueling will carry expectant mothers up to and including the 27th week of the pregnancy without a physician’s certification. If the flight will take place in the 28th to the 35th week of the pregnancy, a physician’s certification (original copy) that the passenger is fit to travel must be submitted. This must include the period of validity, the physician’s professional credentials (i.e. identifying number of the professional society) and the physician’s signature. As of the 36th week Of the pregnancy and beyond, carriage is no longer permitted.

5. Carriage of children

Children below the age of 12 are not permitted to travel without an accompanying person aged 16 or older. Children between the ages of 5 and 12 (11 + 364 days) are permitted to travel alone if the service offered by VUELING for unaccompanied children is booked and the respective fee paid. This service can also be booked as an option for children between the ages of 12 and 17 (17 + 364 days).

• For safety reasons, infants less than 7 days old are not permitted on board. Children from the age of 7 days up to 2 years old (1 + 364 days) may travel on a parent’s lap; child seats or cradles cannot be set up in the cabin. A maximum of 6 children between the ages of 5 and 8 who are using the service for unaccompanied children will be permitted on board as well as 1 infant per adult over 18 years of age (infant is not entitled to a seat).
• Both VUELING and the local authorities at the departure and arrival airports can request to see the infant’s or child’s documentation papers at any time, so we recommend that you always have these handy.
• Passengers who are 14 years of age and older shall only be allowed to board if they have valid personal identification or a valid passport issued in their name. Passengers who are 12 years of age and older must also have a passport or personal identification, but in this case, the family documentation is sufficient in case of a domestic flight on which they are traveling with a parent.
Authorities can also require that a child under the age of 18, who resides in a certain country and is traveling without his or her parents or legal guardian, present a form signed by a parent or legal guardian. Without this form, the child shall not be allowed on board. A specific case in this respect is the country of Romania, where it is required that children under the age of 18 who are traveling alone or accompanied by just one parent must present an official certificate signed by both parents. Details regarding the requirements for international flights from specific countries are found below:

• Flights to the Czech Republic: Children 15 years of age and older must have their own passports in order to fly out of/into the Czech Republic.
• French citizens under the age of 18: Children under the age of 18 who are traveling without either parent or a legal guardian and are leaving French territory:
• For flights within Europe, they must have personal identification or a passport.
• For flights from French territory to a country outside of Europe, in addition to personal identification or a passport, an authorization signed by both parents or a legal guardian is required. Children under the age of 18 who are flying with a valid passport do not need such an authorization because the passport is effective as the consent or authorization of the parents/guardian.

• Spanish citizens under the age of 18: Spanish citizens under the age of 18 who are traveling without one of their parents or a legal guardian and who are leaving Spanish territory without their parents/guardian: They must have the Spanish personal identification (DNI) and also have a completed travel authorization form filled out by their parents/guardian (not valid if only one parent has signed the document; both parents must sign). This authorization form is available at police stations. Children under the age of 18 who are flying with a valid passport do not need such an authorization because the passport is effective as the consent or authorization of the parents/guardian.

• Italian citizens under the age of 14: On domestic flights, children under the age of 14 are allowed to travel if accompanied by persons other than their parents as long as they present personal identification. Children between the ages of 14 and 17 are allowed to travel alone.

Children must always present one of the documents specified in the Italian regulation “Decreto del Presidente della Repubblica” No. 445 of 28 December 2000.

On international flights, children under the age of 15 must present their personal identification, passport or travel permission and must be accompanied by an adult. If they are traveling with their parents or legal guardian, the name of the respective adult must be provided. If they are traveling with an adult without any legal relationship to the child, in addition to the child’s identification documentation, an explanation regarding the limited guardianship for a trip outside of Italy must be presented. This explanation must be notarized, including the name of the person accompanying the child or the company or institution responsible for the child.

The child must always present one of the following documents: (i) personal identification valid for traveling outside the country, including destinations in the EU or to countries with bilateral agreements with Italy, (ii) a personal passport, (iii) travel permission (applies only for certain destinations) or a birth certificate or an excerpt of the birth certificate with a photo issued at the place of birth and notarized by the respective authorities.

For travel by underage children associated with schools, the name of the person, school or institution responsible for organizing the travel must appear in the limited letter of custodianship for travel outside of Italy.

• A child under the age of 18 who is flying to Portugal must:
• Travel with a parent or legal guardian, or
• Be met at the airport or arrival point by a parent or guardian, or
• For travel without an accompanying parent or legal guardian, the child must carry a travel authorization letter written by a parent or legal guardian. This document must include the name of the adult who will be responsible for the child during his or her stay in Portugal.

Underage residents of Portugal who are leaving Portugal: All underage children living in Portugal, regardless of whether or not they are Portuguese citizens, must carry a notarized letter of authorization from a parent or legal guardian if they wish to leave the country unaccompanied. If the underage child is travelling with a third party, the letter of authorization must also include the name of the person responsible for him or her.
The letter of authorization must be issued by:

• One of the underage child’s parents (if the parents are married)
• The parent with whom the child lives (if the parents are separated or divorced)
• One of the child’s adoptive parents (if the child is adopted), or
• The child’s legal guardian.

A standard form for underage children who wish to leave the country is available on the web site of the Portuguese immigration service. “Requerimento de Certidão” for Portuguese citizens. “Termo de Responsabilidade” for citizens of other countries.

• Romanian citizens under the age of 18: Underage Romanian children are permitted to leave Romania, if they:
• Are traveling with both parents, or
• Are traveling with one parent and are carrying a letter of authorization from the parent who is not accompanying them, or
• Are traveling with a legal guardian (neither father nor mother) and are carrying a letter of authorization from their parents as well as certificate of good conduct without any previous convictions.

If the child is traveling alone:
• The child must be carrying a letter of authorization from both parents;
• If the parents are divorced, the letter of authorization must be issued by the parent who has legal custody of the child and it must be accompanied by a copy of the final divorce decree. If one of the parents has died, the letter of authorization must be accompanied by a copy of the death certificate.

 

6. Passengers with reduced mobility

In airports located in the EU, assistance for passengers with disabilities or reduced mobility is the responsibility of the individual airport. If a passenger has indicated his or her disability at least 48 hours before departure, Vueling shall ensure that a request for assistance is submitted to the service provider at the respective airport. If you arrive at the airport, please go to one of the meeting points set up by the service provider and ask for assistance. We recommend that you find the closest meeting point shown on the airport’s site plan.
At airports outside of the EU, Vueling shall make assistance available to passengers with disabilities or reduced mobility in accordance with the legally applicable regulations as long as they have requested assistance at least 48 hours before the flight.
Vueling shall make assistance available to passengers with reduced mobility at no cost as indicated in Annex II of Regulation (EC) No. 1107/2006 of 5 July 2006, as long as they have indicated the need for special assistance and are departing, arriving or transiting through an airport shown on a ticket or connecting ticket.
Passengers with leg casts are allowed to fly if they have a physician’s certificate that indicates that the cast was put on more than 24 hours before departure, and if both of the following conditions are met:

• If the passenger has a cast below the knee, the passenger must book two seats.
• If the passenger has a cast up to the groin area, the passenger must book three seats.
The passenger is not allowed to book one single seat in the Priority, Excellence or XL categories in order to avoid complying with these conditions. The passenger must definitely contact the service center of the respective airline in order to book the seat or adjacent seats.

 

7. Carriage of baggage

7.1 General information
Before checking their baggage, passengers must attach an identification tag with valid and current contact information. From the moment of check-in, VUELING assumes liability for the passenger’s baggage. The airline gives the passenger a baggage claim check, which provides evidence of baggage check-in and which the passenger must keep until the baggage is reclaimed.

7.2 Baggage weight per passenger
Baggage that is not considered free, particularly due to its weight, bulkiness or other difficulties, can only be carried on payment of a supplementary charge. The free baggage allowance per passenger can be found in the fare information.
In every fare category, passengers can check more than one piece of baggage if they pay the respective surcharge per piece of baggage. For a surcharge, baggage up to a maximum weight of 32 kg per piece can be checked.
Vueling can refuse to carry part or all of a passenger’s baggage which exceeds this weight or was not paid for in advance.
A completely folded stroller, baby basket or baby bed can be transported for infants and children up to two years of age at no cost.

7.3 Carry-on baggage
Each passenger is allowed to carry exactly one piece of carry-on baggage that weighs up to 10 kg with maximum dimensions of 55 x 40 x 20 cm.
In addition, at no extra cost, they may carry on item that is significantly smaller than 55 x 40 x 20, e.g. a carry-on bag, a purse or a camera or video camera.
At the gate, if any carry-on baggage that does not meet the airline’s rules, i.e. it is heavier or larger than described above or the passenger is carrying on more pieces than allowed, it will be stored in the airplane’s cargo area for a surcharge.
The airline reserves the right to cancel a booking and to refuse to board any passengers who do not comply with the carry-on baggage specifications listed above.
Items that do not meet the dimension specifications for carry-on baggage (including musical instrument, among other items), are not allowed to be transported in the passenger cabin, unless the passenger has paid for a ticket or connecting ticket for the specific items.

The following items are not allowed as carry-on baggage:

Firearms and other objects that are able to fire projectiles (including all firearms such as pistols, rifles and shotguns, toy pistols, imitation firearms, components of firearms, telescopic sights, air guns and CO2 guns, signal rockets, starting and signal pistols, bows, crossbows and arrows, harpoons and firearms for fishing, slings and rubber slings).

Equipment used specifically to stun or immobilize (including ballistic conducted energy weapons (taser), shocking devices, cattle prods or animal humane killers and chemical substances, gases and defensive or anaesthetic sprays, e.g. tear gas, acid sprays or animal repellent sprays).
Objects with a sharp point or sharp edge (including axes and cleavers, pickaxes and ice picks, knives and pocket knives with blades of more than 6 cm, razor knives and blades, ski and hiking poles, scissors with blades of more than 6 cm, martial arts equipment with a sharp point or sharp edge, and swords and sabres).
Blunt instruments (such as baseball and softball bats, clubs and batons, and martial arts equipment).
Explosives and highly incendiary substances and devices (such as ammunition, blasting caps, detonators and fuses, replica or imitation explosive devices, mines, grenades and other explosive military stores, fireworks and other pyrotechnics, smoke-generating canisters and cartridges, dynamite, gunpowder and plastic explosives).
Tools capable of being used either to cause serious injury or to threaten the safety of aircraft (e.g. crowbars, drills and drill bits, tools with a blade or a shaft of more than 6 cm, such as screwdrivers and chisels, saws, blowtorches and nail guns).
In accordance with Regulation (EU) No. 185/2010, only containers with a maximum volume of 100 ml are allowed to be used to contain liquids, aerosols and gels (e.g. toothpaste, hair gel, drinks, soups, shaving foam, lotions, spreadable food items and other items with similar consistencies) in carry-on baggage. These items must be stored in a transparent, resealable plastic bag with a maximum volume of 1000 ml. Each person is allowed to bring only one bag.
In addition, liquids or semi-solid substances that are needed while on board the flight for medical or special dietary reasons (e.g. baby food) are permitted on board. The passenger must provide proof that these substances are what they are purported to be.
The liquid purchased at the following locations are allowed on board:
In airport shops located beyond the safety checkpoints and at sales points associated with safety procedures that have been authorized through the airport safety program, as long as the liquids are packaged in a bag that has not been manipulated and it can be shown that they were purchased at the respective airport on the same day.

At sales points in the restricted safety zone associated with safety procedures that have been authorized through the airport safety program.
In shops located in other EU airports, as long as the liquids are packaged in a bag that has not been manipulated and it can be satisfactorily shown that they were purchased at the respective airport on the same day.
VUELING recommends that you read these rules and check all of the applicable prohibitions related to carry-on baggage.
VUELING shall always refuse to transport carry-on baggage that does not meet the requirements specified in the rules listed above. Financial reimbursement is not possible.
The carry-on baggage must fit into the closed baggage compartments in the upper section of the cabin, under the seat or in other areas indicated by the cabin crew. Passengers are liable for damage sustained by VUELING or third parties due to the passenger’s baggage, unless it is caused by negligence on the part of VUELING.

7.4 Checking baggage and retrieving checked baggage
Passengers can pick up their baggage immediately after the airline has brought it to the specific area for baggage at the destination airport. If the person holding the baggage claim check or ticket picks up the baggage within the legally specified time period without objection, complaints may not be made at a later time.
If the passenger’s baggage is lost, the passenger authorizes VUELING or a third party to make the inquiries required to find its owner and, in so doing, to make use of objects or elements located inside or outside of the baggage, though the personal information obtained in this way must be kept confidential at all times.
If passengers do not claim their baggage within a period of 7 days after it is made available, the airline can require that a storage fee of 10 euros per day be paid. If passengers do not claim their baggage within a maximum of six (6) months after it is made available, VUELING can handle/dispose of it without any liability.
If a passenger wishes to claim a piece of baggage and cannot present the respective baggage claim check, that specific piece of baggage shall only be given out if the passenger can prove to the airline’s satisfaction that he or she has a right to claim it. If VUELING requires such proof in justified cases, before claiming the baggage, the person must demonstrate that he or she has satisfactory financial means to cover any losses, damage or expenses incurred by the airline for transferring the baggage.
VUELING can stop or refuse the transfer of the baggage to the passenger, if he or she is carrying baggage that appears suspicious or if another passenger has requested to claim it or if it is being claimed by the Spanish national security forces or the security forces in any other country. In this case, the passenger must comply with the legally binding regulations for claiming the baggage and the airline does not accept any liability for any related delays or refusal to transfer the baggage.
If passengers have purchased two or more point-to-point flights, they alone are responsible for planning for enough time to claim the baggage as necessary, recheck it, go through the security and passport control checks and arrive at the gate to board the second and/or the next flight in a timely manner. The previous rules do not apply for connecting flights.
If there are connecting flights, passengers must check their baggage at the departure airport and pick it up at the final destination. The airline is responsible for handling the baggage at the stopovers along the route.

7.5 Damage to baggage
If baggage is lost or damaged, the respective international and national standards shall apply; in particular, the Aviation Act of 1960 and the Montreal Convention of 28 May 1999 as well as Regulation (EC) No. 2027/97 of the Council.
In case of destruction, loss or delay of or damage to baggage, VUELING is liable up to the maximum amount of 1131Special Drawing Rights. The passenger can select a greater liability level by submitting a special declaration of value and pays the respective surcharge. VUELING always carries liability for checked baggage; however, for carry-on baggage the company is only liable for damage for which it is at fault.
If baggage is damaged, lost or destroyed or arrives late, passengers must inform VUELING as soon as possible: within 7 days if it is damaged and within 21 days if it is lost. These periods begin when the baggage is picked up.
VUELING is never liable for scratches, bends or stains or damaged handles and/or wheels on baggage unless (i) it can be proven that the baggage was in perfect conditions before it was checked and became the responsibility of VUELING, (ii) the damage is specified, and (iii) the damage in question occurred while VUELING was responsible for the baggage.
Passengers are hereby notified that VUELING is not liable for damage to perishable or fragile items that are carried as checked or carry-on baggage unless (i) it can be proven that the respective items were packed correctly, (ii) the damage is specified, and (iii) it is proven that the damage in question occurred while VUELING was responsible for the baggage. For further information, see our regulations on perishable and fragile items.
If the airline that carries out the flight is not VUELING, passengers can direct their complaints to that airline.

7.6 The right of the transportation company to inspect baggage
For reasons of safety, we can request that you allow your baggage to be searched with X-rays or any other type of scanning device. Your baggage can also be checked together with the responsible authorities without you being present, if you are not available, (locks on the baggage may also be removed) in order to determine if the baggage contains any of the items listed in sections 7.7 and 7.3.
If you are not ready to comply with the requirements listed in the previous paragraph, we can refuse to transport you or your baggage without a refund or any other liability. If the check or scan causes damage to you or if the X-ray procedure or scan damages your baggage, we are only liable for this damage if it occurred due to our fault or negligence.
If requested to do so, you must go to have your baggage checked by customs officials or other government agents and both your carry-on and checked baggage is subject to these checks. We are not liable to you for any losses or damage you incur if you do not respond satisfactorily to this request unless it is due to our negligence.

7.7 Dangerous goods
Without previous, express permission, no items can be transported in the cargo area or in the cabin which endanger the aircraft or persons or property on board, such as those specified in the regulations on dangerous goods of the International Civil Aviation Organisation (ICAO) and the International Air Transport Association (IATA). These include, among others, compressed air bottles, flammable liquids and solid substances, poisons, radioactive material, corrosive substances, firearms and explosives. If you have any questions as to which items you are permitted to transport either in the aircraft cabin or in the cargo area or where certain items should be transported, please contact Vueling before your trip or ask at the sales desk or customer service desk when you arrive at the airport.

8. Transportation of animals

A passenger that normally relies on an assistance dog is permitted to travel with it in the cabin on the condition that the animal is properly restrained and that the passenger is liable for related damages that other passengers may incur.
Passengers who wish to bring animals along with them in the aircraft cabin (animals cannot be transported in the cargo area) can book this service in the Vueling service center (see section 2.2). Additional costs apply and the following conditions must be met:

• Only animals such as dogs, cats, birds (no birds of prey), fish and water turtles are allowed. Other types of animals such as rodents, rabbit-like mammals (lagomorphs), farm animals or animals associated with unpleasant smells (e.g. ferrets) or noises or that endanger security or safety on board are not permitted.

• The animal must be transported in a special travel cage that is not rigid and which has air holes and a waterproof floor; containers made or modified by passengers themselves are not permitted. Airport personnel or the cabin crew have the right to refuse transport if a container/cage is not suitable or secure.
• The maximum cage dimensions are 45 cm long, 39 cm wide and 21 cm high.
• The maximum permissible total weight of the cage (including contents) is 8 kg.
• Food and water containers must be closed so that the contents do not spill.
• The cage must be transported on the floor, between the passenger’s feet or below the seat. Transportation of the cage on the passenger’s lap or on the seat next to the passenger is prohibited, even if the seat is available.
• Vueling can refuse carriage to animals that could cause a nuisance to other passengers due to certain characteristics (odor, health or hygienic condition, aggressive behavior).
• Passengers who bring animals with them are obligated to take care of them at all times and to react properly if problems occur.
• While on board, the animal is not ever permitted to be taken out of the cage.
• Only one animal per cage is permitted for transport (except for birds and similar small animals).
• Animals are not allowed to be transported on XL seats.

Passengers must ensure that the animal is permitted to be taken into the country based on that country’s laws and that (i) the applicable hygienic regulations are met without exception, and (ii) that they have all of the required documentation for having and transporting the animal.
Passengers are obligated to pay all additional costs (e.g. taxes due in the destination country) that VUELING may incur by providing carriage to their animals without the required documentation.
Only two animals are allowed on board the aircraft per flight. If this amount has been reached, the option for bringing an animal along can no longer be selected in the electronic reservation system.
VUELING does not offer the option of transporting animals in the aircraft cargo area.

9. Electronic devices

On board VUELING aircraft, passengers are allowed to use the following personal electronic devices (“PED”):
o Mobile telephones (“smart phones”);
o Electronic tablets;
o Electronic headphones for environmental noise suppression;
o MP3, MP4 and similar players as well as digital music playing devices;
o Small, portable electronic games;
o Laptops and Notebooks;
o Portable reading devices, commonly called E-book readers;
o Bluetooth devices;
o Personal digital photo and video cameras (no professional equipment). Permission to use these devices does not include the option to take photos of the crew or any of the elements of the aircraft;
o Small DVD/CD playback devices;
o Headphones that are not wireless (except for on the runway and during take-off and landing).
o However, at any time during the flight, the cabin crew can require that all electronic devices be switched off and stored in carry-on baggage (even if the devices have an available flight mode).
o The use of mobile telephones and other electronic, hand-held devices that transmit electromagnetic waves is permitted on board VUELING aircraft as long as the doors are open.

As soon as the doors are closed, these devices must be used only in flight mode in accordance with the following table:
o Phase
o Hand-held PEDs
o Heavy PEDs
o Personal headphones
o Wi-fi, message transmission and speech functions

Electronic devices in checked baggage must be switched off at all times. The use of electronic cigarettes is prohibited at all times on all Vueling aircraft.

10. Alcoholic beverages

Bringing alcoholic beverages on board is not permitted, with the exception of those purchased on board.

11. Responsibility and authority of the pilot in command

The pilot in command shall at all times be entitled to take all necessary safety measures. In this respect, he or she shall have full decision-making authority with regard to passenger seating as well as the loading, distribution, securing and unloading of baggage. He or she shall make all decisions concerning whether and how the flight is to be operated, whether and how deviations are to be made from the planned route, and where a landing or intermediate landing is to be made. The same applies if a passenger’s conduct, physical or mental condition is such that an unduly high level of assistance would be required on the part of the in-flight staff.

12. Restriction/refusal of carriage for reasons of safety

12.1 Restriction of carriage
The airline reserves the right to refuse carriage to a passenger holding a ticket at any time, based on the airline’s judgement in the following cases: • If it is necessary or appropriate for reasons of public safety and security.
• If it is necessary or appropriate in order to comply with the laws or regulations of the country of flight origin, destination or transit.
• If it is necessary or appropriate due to the passenger’s behavior, state, age or mental or physical condition.
• If it is necessary or appropriate in order to prevent serious damage, inconveniences or disadvantages for other passengers or the cabin crew.
• If it is necessary or appropriate because the passenger previously and repeatedly does not comply with the airline’s rules.
• If the passenger present a document to the airline which (a) was presumably obtained illegally, (b) has been reported as lost or stolen, or (c) is presumably falsified or contains modifications of some type which were not made by the airline. In these cases, the airline reserves the right to retain the specific documents.
• If the person who arrives at the airline service counters is not the owner of the ticket. In this case, the airline reserves the right to retain the specific ticket. If the passenger cannot prove that he or she paid the total price of the ticket or if the cancellation of the payment has been reported to the credit card company with which it was paid. 12.2 Conduct on board the aircraft
If, in the opinion of the airline personnel, the passenger’s conduct on board the aircraft is such that he or she is endangering the aircraft or any person or property on board, hindering the crew or failing to comply with any instructions of the crew, or if the passenger threatens, insults or abuses a member of the crew or behaves in an outrageous or any other manner that other passengers could find offensive, the airline personnel may take such measures as they reasonably consider necessary to prevent the continuation of such behavior, including refusing further carriage (deplaning). Afterward, VUELING shall take any legal action, civil or criminal, to which it is entitled under the law.
If, as a result of the passenger’s conduct on board the aircraft, the captain reasonably decides to deviate from the planned route in order to remove the passenger from the plane, the passenger shall be responsible for all costs and expenses related to this course change and landing. 12.3 Seat selection and change in selection
If passengers would like to change a previously reserved seat, Vueling shall assign them new seats, depending on availability and their respective request; however, the price paid for the initial seat reservation shall not be refunded.
The flight or cabin personnel is entitled to change a passenger’s seat as required for flight safety. This primarily occurs with seats in the emergency rows, where passengers who require a longer safety belt are not allowed to sit, along with pregnant passengers, underage passengers who are not yet fifteen years old, passenger with small children, disabled passengers or, in general, passengers who are not able to assist the cabin crew as necessary in case of emergency, which is required of all passengers who sit in these seats.

13. Liability

The liability of TUI fly and Vueling is based on the provisions specified in the General Terms and Conditions of Business and Carriage ("GTCC").

14. Personal information

In the context of the respective legislation, the passenger allows TUI fly and Vueling to retain all of the personal information that was supplied to TUI fly and/or Vueling or an authorized agent by the passenger for the purpose of reserving the flight.

(a) This information is important for additional services, such as investigating fraud or deception with respect to baggage, preventing and determining ticket fraud, complying with entry and exit regulations and communicating with authorities.
(b) In addition, TUI fly and Vueling are authorized to transmit personal data for these purposes to its own offices, to authorized agents, to other airlines, other service providers and public authorities in Germany and abroad.

15. Alterations

No agency, employee or other third party is entitled to alter or add to these STCC Vueling or to waive their applicability.

16. Verbal agreements

These STCC Vueling and the GTCC TUI fly contain the entire provisions of the contract between the passenger and TUI fly and supersede all previous agreements, regardless of whether such agreements were made verbally, by electronic means or in writing. In case of conflict between these STCC Vueling and the GTCC, the GTCC shall take precedence.

17. Invalidity of one or more provisions

Should any individual provision be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a provision which comes as close as possible to the economic purpose of the invalid provision.

18. Applicable law and place of jurisdiction

The contractual relationship between the passenger and TUI fly shall be governed by the laws of the Federal Republic of Germany, irrespective of the passenger's nationality. Legal venue for registered traders, persons who have no general legal domicile inside the country and persons who have transferred their residence or habitual abode to a place outside Germany after conclusion of the contract or whose residence or habitual abode is unknown when the lawsuit is filed, shall be Hanover (Germany). This legal venue provision shall not apply within the substantive scope of the Warsaw Convention or the Montreal Convention.
